Annex 1 - Mandatory Conditions
No supply of alcohol may be made under this Premises Licence:
a) at a time there is no designated premises supervisor in respect of the premises licence and,
b) at a time when the designated premises supervisor does not hold a personal licence or the personal licence is suspended and,
Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
The admission of children to an exhibition of a film where the film classification body or this Council has determined the classification must be restricted in accordance with that classification. The film classification body is the British Board of Film Classification. In this condition children means persons under 18 years of age.
Films must be classified in the following way:
U - Universal. Suitable for audiences aged four years and over.
PG - Parental Guidance. Some scenes may be unsuitable for young children.
12A - Passed only for viewing by persons aged 12 years or older or persons younger than 12 when accompanied by an adult.
15 - Passed only for viewing by persons aged 15 years and over.
18 - Passed only for viewing by persons aged 18 years and over.
Immediately before each exhibition at the premises of a film passed by the British Board of Film Classification there shall be exhibited on screen for at least five seconds in such a manner as to be easily read by all persons in the auditorium a reproduction of the certificate of the Board or, as regards a trailer advertising a film, of the statement approved by the Board indicating the classification of the film.
Where a programme includes a film recommended by the licensing authority as falling into the 12A, 15 or 18 category no person appearing to be under the age of 12 and unaccompanied, or under 15 or 18 as appropriate, shall be admitted to any part of the programme; and the licence holder shall display in a conspicuous position a notice in the following terms:
PERSONS UNDER THE AGE OF [INSERT APPROPRIATE AGE] CANNOT BE ADMITTED TO ANY PART OF THE PROGRAMME.
Where films of different categories form part of the same programme, the notice shall refer to the oldest age restriction.
This condition does not apply to members of staff under the relevant age while on-duty provided that the prior written consent of the person's parent or legal guardian has first been obtained.
Each individual carrying out a security activity must be licensed by the Security Industry Authority.
A record shall be kept of the names and registration number of such persons and this record shall include the circumstances including full details of all events that take place during their period of duty.
Annex 2 - Conditions consistent with the Operating Schedule
1. Noise from amplified and non-amplified music, singing and speech arising from regulated entertainment at the premises [between the hours of 23:00 and 07:00] shall not be audible inside habitable rooms of noise sensitive properties in the vicinity.
Informative Note:
For the purpose of providing an objective standard to assess whether this condition is being complied with or not, noise shall be considered not to be audible if:
a) the measurement of sound when music etc is on (expressed as LAeq, 1min) does not exceed the measurement of sound (expressed as LA90, 5min) when the music is off, and
b) the measurement of sound in each 1/3rd octave band between 40Hz and 160 Hz when music is on (expressed as L10, 1min) does not exceed the measurement of sound in the same 1/3rd octave bands between 40Hz and 160Hz when the music is off (expressed as L90, 5min)
All measurements to be taken within the habitable room normally occupied at the time in question, using a Type 1 integrating-averaging sound level meter compliant with BS EN 60804, with either windows open for normal ventilation or closed, whichever situation causes greater noise disturbance.
Licensees are advised to carry out a simple “sound check” outside the nearest noise sensitive property by listening to the music etc. coming from regulated entertainment. If the music etc. is clearly audible then it is likely that this condition is being breached. Steps should then be taken to reduce the volume of the noise.
2. All external doors and windows to the room/s where regulated entertainment is being provided shall remain closed during the course of the entertainment, other than for normal access and egress.
3. All external doors (including fire-exit doors and patio doors) to the premises shall not be propped open during the course of regulated entertainment.
4. Amplified and non-amplified music, singing and speech associated with the regulated entertainment shall only be carried out inside the premises except with the prior written approval of the Licensing Authority.
5. No speaker used to relay amplified music, singing and speech provided as part of the regulated entertainment shall be positioned outside the building structure of the premises, nor shall any speaker be positioned internally such that the sound is intentionally directed through external doors, windows or other openings in the structure.
6. All amplified music, singing and speech provided as part of the regulated entertainment shall only be played through the in-house sound amplification system.
7. Prominent, clear notices shall be displayed at all exits requesting customers and staff to respect the needs of local residents and leave the premises and area quietly.
8. All refuse and waste bottle receptacles shall be kept in a secure storage area that is obscured from the view of pedestrians.
9. Promotional leaflets (flyers) shall not be distributed to the public outside the premises (whether immediately outside or some distance away) except with the prior written approval of the Licensing Authority, and under the terms of a litter control plan approved by the Responsible Authority for Public Nuisance (Wakefield MDC’s Environmental Protection Team).
10. At the end of business every day/night the pavement to the frontage (and sides) of the premises shall be cleared of litter and waste and cleansed of any urine, vomit or similar fouling.
11. The Designated Premises Supervisor shall continue to remain a member of the Local Pubwatch scheme for as long as such scheme remains in existence.
12. Any person on the premises who appears to be under 21 years of age attempting to purchase alcohol from the establishment shall be challenged to produce photographic evidence to ascertain their proof of age.
13. The following forms of photographic evidence will be accepted to ascertain a person's age:
(a) National passport
(b) Photographic Driver's Licence
(c) United Kingdom 'PASS' accredited age identification card with photograph
14. CCTV shall be used on the premises. Cameras must be kept in full working order and the recordings shall be retained for a length of time in accordance with local police advice.
15. All glasses that are used on the premises shall continue to be either made from toughened glass or plastic.
16. The store shall maintain a refusals log book and keep the log fully up to date with reference to recording those suspected of being under the age of 18.
17. The store management shall regularly inspect the refusals log to ensure that it is being properly maintained.
18. The Door Supervisor register shall be made available to Police Officers or authorised officers of the Council on request.
19. The Designated Premises Supervisor shall, as soon as is reasonably practicable within 72 hours, notify the Security Industry Authority of any door supervisors dismissed for serious misconduct which might reasonably affect the continuation of such registration.
20. The Designated Premises Supervisor shall take all reasonable precautions and exercise all due diligence to ensure that the soliciting for the purposes of prostitution does not occur.
21. The Designated Premises Supervisor shall take all reasonable precautions and exercise all due diligence to ensure the safety of performers whilst on the premises, whilst entering the premises and on leaving the premises.
22. Only the performers shall provide the entertainment, no audience participation must be permitted.
23. In the public area all performers shall at all times as a minimum requirement wear a non-transparent G-string or similar piece of clothing on the appropriate part of the body and at no time will reveal any part of their genitalia or anus in the public.
24. During any performance of lap dancing, striptease or nude dancing (including performances usually termed 'private dances') there must not be any physical contact, by the performer, with any person in the viewing audience except:
(a) Leading a patron hand in hand to and from a chair or private room.
(b) Simple handshake greeting at the beginning and/ or end of the performance.
(c) The placing of monetary notes or dance vouchers in the hand or garter worn by the performer.
(d) Pecking the cheek of a patron at the conclusion of the performance.
25. Customers shall remain seated whilst watching a performance. Performers must report all inappropriate behaviour and breaking of the house rules to the management.
26. The Designated Premises Supervisor shall have in place "House Rules" regarding performers/staff/customers which shall be clearly displayed in the premises where they can be easily read by all persons attending the premises.
27. Notices in addition to 26 above must be clearly displayed on each table, at each bar area and at the entrance to the premises stating there must not be any physical contact between customers and performers except:
(a) Leading a patron hand in hand to and from a chair or private room.
(b) Simple handshake greeting at the beginning and/ or end of the performance.
(c) The placing of monetary notes or dance vouchers in the hand or garter worn by the performer.
(d) Pecking the cheek of a patron at the conclusion of the performance.
28. Performers shall not:
(a) climb onto furniture provided for patrons.
(b) simulate sex acts.
(c) remain in a state of undress when they have completed their act.
(d) use any sex articles as defined by the Local Government (Miscellaneous Provisions) Act 1982 and there shall be no penetration of the genital area or anus by any means.
29. Any person who can be observed from outside of the premises must be properly and decently dressed. Scantily clad individuals must not exhibit in the entranceway or in the area surrounding the premises. There shall be no attempt made outside the premises to solicit people to enter.
30. There shall be no external advertising of the striptease entertainment either at the premises or in its immediate vicinity.
31. The Designated Premises Supervisor or some other responsible person over the age of 21 years, nominated by the Designated Premises Supervisor in writing, shall be in charge and be present on the licensed premises during the whole of the time that entertainment is taking place.
32. A minimum of two Door Supervisors registered with the Security Industry Authority must be on duty at all times the premises are operating with adult entertainment.
33. Door Supervisors shall continually monitor all entrances, exits and toilets.
34. Closed Circuit Television Cameras (CCTV) shall be provided by way of a recordable camera system capable of providing pictures of evidential quality in all lighting conditions and a type that indicates on the recording the date and time of the recording.
35. Cameras shall encompass all ingress and egress to the premises, the licensed area and the surrounding area of the premises, and any other areas as required by the Police.
36. CCTV equipment shall be maintained in good working order and recordings kept in date order, numbered consecutively and retained in a secure place for a period of 28 days.
37. Recordings shall be made available to the Licensing Authority or a Police Officer on demand.
38. No still or moving photographic recordings or other recordings, other than under condition 34 to 36 above, shall be made of any performances.
39. No persons under the age of 18 shall be allowed to enter or remain on the premises when adult entertainment is taking place.
