Annex 3 - Conditions attached after a hearing by the licensing authority
1. CCTV
1.1 A CCTV system to a specification required by West Yorkshire Police and in accordance with current Home Office Guidelines be installed and utilised at the premises with a sufficient storage capacity to store a minimum of 31 days footage: recording at a minimum of 7-12 Frames per Second (FPS). (Advisory Note:-The CCTV System must be registered with the Information Commissioners Officer (ICO) to ensure compliance with the Data Protection Act 1998 (DPA);
1.2 Cameras shall be installed and located in all entry and exit points, serving area, circulation area and toilet access points, this will enable the capture of images to be of a standard which allows them to be identified (as defined in the Information Commissioner’s Office current “Codes of Practice”). A camera shall also be installed externally, over the entrance door, covering the walk way in to the premises;
1.3 Staff shall be trained in the use of the CCTV system to ensure rapid data retrieval. Down loads will be provided to the Police and Local Authority, immediately on request;
1.4 CCTV shall be active during licensing hours and at least one member of staff who is trained in downloading from the system shall be on the premises during trading hours;
1.5 In the event of a failure of the CCTV system for any reason, a record of the failure will be recorded in the premises’ incident book and immediate steps will be made to rectify the problem. All actions taken to remedy the CCTV faults(s) shall be recorded in the incident register.
2. Training
2.1 Staff shall, within 14 days of their commencing employment at the premises, receive training on matters including, the refusal of service to persons who are intoxicated, drugs awareness and the provision of the training shall be recorded in writing;
2.2 Refresher training shall be provided to all staff on a 6 monthly basis and recorded in writing;
2.3 All staff training records will be made available to the Police and/or Local Authority Licensing Officers on demand.
3. Incident Register
2.3 The premises shall keep an incident register to record all incident of crimes reported to the premises, anti-social behaviour, injury, ejections from the premises, any incident of disorder, seizures of drugs and faults with the CCtv system and any visit by the Police or Licensing Authority Officer;
2.4 The register shall also include the details of any Police Officer who attended any incident, names and address of any witnesses and confirmation of whether there is any footage of the incident. The register will be made available to the Police and/or Local Authority Enforcement Officers on demand.
4. Age Limit
4.1 Children under 14 years of age are not permitted on the premises unless accompanied by an adult;
4.2 Prior to 11pm, any person on the premises who appears under 14 years of age as is unaccompanied shall be challenged to produce photographic evidence to ascertain their proof of age;
4.3 After 11pm, any person on the premises who appears under the age of 18 years shall be challenged to produce photographic evidence to ascertain their proof of age;
4.4 No persons under age of 18 years shall be present on the premises after 11pm.
