Annex 1 - Mandatory Conditions
1. No supply of alcohol may be made under this Premises Licence:
a) at a time there is no designated premises supervisor in respect of the premises licence and,
b) at a time when the designated premises supervisor does not hold a personal licence or the personal licence is suspended and,
2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) games or other activities, which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises, which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
4. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
5. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
6. Each individual carrying out a security activity must be licensed by the Security Industry Authority.
7. A record shall be kept of the names and registration number of such persons and this record shall include the circumstances including full details of all events that take place during their period of duty.
8.-(1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
9. The responsible person shall ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the
following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
Annex 2 - Conditions consistent with the Operating Schedule
1. CCTV
1.1 A CCTV system to a specification required by West Yorkshire Police and in accordance with current Home Office Guidelines must be installed and utilised at the premises with a sufficient storage capacity to store a minimum of 31 days footage;
1.2 All equipment shall be operated and maintained in good and clear working order and recordings shall be kept in date order, numbered and retained for a period of at least 31 days, or as otherwise recommended by the police;
1.3 Staff shall be trained in the use of the system to ensure rapid data retrieval and download when required by Police or Local Authority Enforcement Officers;
1.4 CCTV shall be active on a 24 hour basis and at least one member of staff who is trained in downloading from the system shall be on the premises during trading hours.
2. Training
2.1 New front of house staff shall receive induction training at the commencement of their employment at the premises as their obligations under the Licensing Act 2003 and particularly with regard to avoiding sales to under aged and intoxicated persons;
2.2 All front of house staff shall receive similar refresher training at least twice per year;
2.3 All such training shall be recorded and training records maintained and immediately made available for inspection by West Yorkshire Police and Local Authority Enforcement Officers upon request.
3. Incident /refusals register
3.1 The premises licence holder will maintain an Incident Report Register on the premises to record incidents such as anti-social behavior, admissions refusals and ejections from the premises.
3.2 The Incident Report Register will contain consecutively numbered pages, the date, time and location of the incident, details of the nature of the incident, the names and registration numbers of any door staff involved or to whom the incident was reported, the names and personal licence numbers (if any) of any other staff involved or to whom the incident was reported, the names and numbers of any Police Officers attending, the Police incident and/or crime number, names and addresses of any witnesses and confirmation of whether there is CCTV footage of the incident.
3.3 The register shall be immediately made available for inspection by West Yorkshire Police and Local Authority Enforcement Officers upon request.
3.4 The premises licence holder will maintain a system for recording refusals of sale of alcohol at the premises. The system will record time, day and date of the refusal of sale.
3.5 Records from the system shall be immediately made available for inspection by West Yorkshire Police and Local Authority Enforcement Officers upon request.
4. Pubwatch
The premises shall be a member of the local Pub watch scheme and at least one representative of the premises shall attend each meeting for as long as such a scheme remains in existence.
5. Door Staff
5.1 A minimum of 2 SIA registered door supervisors shall be employed at the premises from 2100hrs until close on Friday and Saturdays, Sundays before Bank Holidays, Christmas Eve, Boxing Day and New Year’s Eve;
5.2 The requirement for additional door supervisors on such days and at all other times shall be risk assessed in conjunction with any specific recommendation of West Yorkshire Police by the premises licence holder and door supervisors shall be employed at the premises in such n umbers and at such times as deemed necessary by the risk assessment.
5.3 A register of door supervisors shall be maintained at the premises setting out details of door staff employed at the premises on each day they are employed.
6. Drug Safe
A drug safe for the use by staff will be fitted in a secure room at the premises out of reach of access by the public. Only management will have access to the drugs safe.
7. Open bottles and vessels.
7.1 No open bottles or vessels shall be permitted entry to the premises at any time during trading hours except for those purchased on the premises and taken for consumption into any outside area under the control of the premises licence holder;
7. 2 No customers shall be permitted to take open bottles or vessels from the licensed area of the premises except for those purchased on the premises and taken for consumption into any outside area under the control of the premises licence holder.
8. Children
8.1 Children under the age of 16 shall not be permitted on the premises unless accompanied by an adult and shall not be permitted to remain on the premises after 22.00 hrs. on any day.
9. The premises shall operate a "Challenge 21" policy at all times.
10. All exit routes must be kept clear and remain free from obstruction at all times.
11. All emergency exit doors are to be unbolted prior to admitting patrons onto the premises.
12. There shall be no use of the rear outside terrace area for the consumption of food and drink outside the hours of 08:00 to 22:00 daily.
13. Waste bottles will not be disposed of into external bins between 23:00h and 07:00h.
