Annex 1 - Mandatory Conditions
1. No supply of alcohol may be made under this Premises Licence:
a) at a time there is no designated premises supervisor in respect of the premises licence and,
b) at a time when the designated premises supervisor does not hold a personal licence or the personal licence is suspended and,
2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
4. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
5. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
6. Each individual carrying out a security activity must be licensed by the Security Industry Authority.
7. A record shall be kept of the names and registration number of such persons and this record shall include the circumstances including full details of all events that take place during their period of duty.
8.-(1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
9. The responsible person shall ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
Annex 2 - Conditions consistent with the Operating Schedule
1. No adult entertainment shall take place on the premises.
2. Children must be accompanied by an adult at all times.
Annex 3 - Conditions attached after a hearing by the licensing authority
1. Non Standard hours - an additional hour on the day that BST begins. New Year's Eve/Day to reflect arrangements.
2. Supply of alcohol - During any UK or Republic of Ireland international sporting event to permit sale of alcohol an hour before, during and one hour after the event (subject to notice to the police). With thirty minutes drinking up time each day save for Friday and Saturday when one hour is permitted. (Full details of which are contained in the Application and Operating Schedule.
3. One hour before, during and one hour after the transmission of any international sporting event involving any of the countries in the UK or Republic of Ireland. Such events limited to 10 in any calendar year and subject to 10 days notice being given to the Licensing Authority and West Yorkshire Police provided that neither party objects to the same within 5 days of such notice being given.
4. Noise from amplified and non-amplified music, singing and speech arising from regulated entertainment at the premises [between the hours of 23:00 and 07:00] shall not be audible inside habitable rooms of noise sensitive properties in the vicinity.
Informative Note:
Licensees are advised to carry out a simple “sound check” outside the nearest noise sensitive property by listening to the music etc. coming from regulated entertainment. If the music etc. is clearly audible then it is likely that this condition is being breached. Steps should then be taken to reduce the volume of the noise.
For the purpose of providing an objective standard to assess whether this condition is being complied with or not, noise shall be considered not to be audible if:
) the measurement of sound when music etc is on (expressed as LAeq, 1min) does not exceed the measurement of sound (expressed as LA90, 5min) when the music is off, and
) the measurement of sound in each 1/3rd octave band between 40Hz and 160 Hz when music is on (expressed as L10, 1min) does not exceed the measurement of sound in the same 1/3rd octave bands between 40Hz and 160Hz when the music is off (expressed as L90, 5min)
All measurements to be taken within the habitable room normally occupied at the time in question, using a Type 1 integrating-averaging sound level meter compliant with BS EN 60804, with either windows open for normal ventilation or closed, whichever situation causes greater noise disturbance.
5. All external doors and windows to the room/s where regulated entertainment is being provided shall remain closed during the course of the entertainment, other than for normal access and egress.
6. Prominent, clear notices shall be displayed at all exits requesting customers and staff to respect the needs of local residents and leave the premises and area quickly and quietly
7. All external areas of the premises (beer gardens, patios etc) must not be used by customers between the hours of 21:30 and 12:00 excluding the smoking area.
8. No speakers used to relay amplified music, singing and speech provided as part of the regulated entertainment shall not be positioned outside the building nor shall any speaker be positioned internally such as that sound is directed out through external doors, windows and other openings in the structure.
9. The licence holder shall arrange to provide a taxi request service for customers with local firms who agree that drivers will not sound horns in the vicinity of the premises and will erect notices in the premises encouraging customers to use such firms. In the event that drivers ignore such a request the licence holder shall terminate the arrangement with that firm.
10. CCTV
10.1 A CCTV system to a specification required by West Yorkshire Police and in accordance with current Home Office Guidelines be installed and utilised at the premises with a sufficient storage capacity to store a minimum of 31 days footage;
10.2 All equipment shall be operated and maintained in good and clear working order and recordings shall be kept in date order, numbered and retained for a period of at least 31 days, or as otherwise recommended by the police;
10.3 Staff shall be trained in the use of the system to ensure rapid data retrieval and download when required by Police or Local Authority Enforcement Officers;
10.4 CCTV shall be active on a 24 hour basis and at least one member of staff who is trained in downloading from the system shall be on the premises during trading hours.
11. Training
11.1 New staff shall receive induction training at the commencement of their employment at the premises, including drug awareness and underage sales training;
11.2 Regular staff training shall be undertaken periodically and recorded;
11.3 Staff refresher training shall take place on a monthly basis and be recorded;
11.4 All staff training shall be recorded and training records maintained and available immediately for inspection by West Yorkshire Police and Local Authority Enforcement Officers upon request.
12. The premises shall adopt a proof of age scheme approved by West Yorkshire Police and West Yorkshire Trading Standards providing for proof of age for sales to persons who appear to be below the age of 25. Signs shall be provided within the premises informing customers that sales shall not be made to persons under the age of 18 and that identification may be required.
13. An Incident Report Register shall be maintained and kept on the premises to record all incidents involving anti-social behaviour, injury and ejections from the premises. The register will contain consecutively numbered pages in a bound format and include the date, time and location of the incident, details of the nature of the incident, the names and SIA badge numbers of any door staff involved or to whom the incident was reported to and names of any other staff involved or to whom the incident was reported. The register shall also include the details of any police officer who attend any incident, names and addresses of any witnesses and confirmation as to whether there is CCTV footage of the incident. This register shall be made available for inspection by West Yorkshire Police or Local Authority Enforcement Officers immediately upon request.
14. The Designated Premises Supervisor or a nominated personal licence holder must be at the premises and contactable at all times during trading hours and a register be maintained on the premises of their details.
15. First Aid
15.1 At least one suitably trained first aider who is responsible for first aid shall be on duty when the public are present and there shall be a notice clearly identifying the first aider. For the avoidance of any doubt, ‘suitably trained first aider’ means that the individual has obtained a qualification in first aid and that the provider of this training and qualification is approved by West Yorkshire Police;
15.2 If more than one suitably trained first aider is present at the premises, their respective duties should be clearly defined;
15.3 The Licensee shall ensure that there is an adequate and appropriate supply of first aid equipment and material at the premises;
16. The premises shall be a member of the local Pubwatch scheme and at least one representative of the premises, responsible for the management and/or running of the premises shall attend each meeting.
17. Open Bottles and Vessels
17.1 No open bottles or vessels shall be permitted entry to the premises at any time during trading hours;
17.2 No customers shall be permitted to take open bottles or vessels away from the premises at any time during trading hours and no drinks shall be consumed outside between 21.30 and 12 noon.
18. Door Supervisors
18.1 SIA and Approved Contractor status door supervisors shall be employed at the premises and shall be on duty from 21.00hrs until close of business every Friday, Saturday, Sunday before a bank holiday and all bank holidays. In addition, if there are significant numbers of customers in the premises prior to this time, it is expected that the Management will have door supervisors working at the ratio below. This condition is to include any private functions at the premises;
18.2 There shall be a minimum number of one door supervisor when the capacity of the premises reaches 50 people. A further Door Supervisor must be introduced when the capacity of the premises reaches 100. Thereafter there shall be at least one door supervisor per additional 100 people or part thereof. These are the minimum requirements and the Management may deem it necessary to have additional door supervisors as events or circumstances dictate;
18.3 At least one female door supervisor shall be on duty at the premises on a periodic basis. The minimum requirement will be at least one every month. This should be recorded in the Door Supervisors Register;
18.4 At least one working Nite Net/CCTV Radio shall be used during trading hours;
18.5 A drugs safe shall be securely fitted in a secure location at the premises which cannot be accessed by the public and to which only the management of the premises shall have access;
18.6 The requirement for additional door supervisors on such days and at all other times shall be risk assessed in conjunction with any specific recommendation of West Yorkshire Police by the premises licence holder and door supervisors shall be employed at the premises in such numbers and at such times as deemed necessary by the risk assessment;
18.7 A register of door supervisors shall be maintained at the premises setting out details of door staff employed at the premises on each day they are employed.
