Annex 1 - Mandatory Conditions
1. No supply of alcohol may be made under this Premises Licence:
a) at a time there is no designated premises supervisor in respect of the premises licence and,
b) at a time when the designated premises supervisor does not hold a personal licence or the personal licence is suspended and,
2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3.-(1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

Permitted Hours
Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours means:
a) On weekdays, other than Christmas Day, 8 am to 11pm
b) On Sundays, other than Christmas Day, 10am to 10.30pm
c) On Christmas Day, 12 noon to 3pm and 7pm to 10.30pm
d) On Good Friday, 8am to 10.30pm
The above restrictions do not prohibit:
a) during the first twenty minutes after the above hours, the taking of the alcohol from the premises, unless the alcohol is supplied or taken in an open vessel;
b) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
c) the sale of alcohol to a trader or club for the purposes of the trade or club;
d) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
OFF LICENCE

Consumption
Alcohol shall not be sold in an open container or be consumed in the licensed premises.
ON-LICENCES

Permitted Hours
Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours means:
a) On weekdays, other than Christmas Day, Good Friday or New Year’s Eve, 10am to 11pm.
b) On Sundays, other than Christmas Day or New Year’s Eve, 12 noon to 10.30pm.
c) On Good Friday, 12 noon to 10.30pm.
d) On Christmas Day, 12 noon to 3pm and 7pm to 10.30pm.
e) On New Year’s Eve, except on a Sunday, 11am to 11pm.
f) On New Year’s Eve on a Sunday, 12 noon to 10.30 pm.
g) On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31 December).
The above restrictions do not prohibit:
a) During the first twenty minutes after the above hours the consumption of the alcohol on the premises;
b) During the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
c) During the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;
d) Consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
e) The ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
f) The sale of alcohol to a trader or club for the purposes of the trade or club;
g) The sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
h) The taking of alcohol from the premises by a person residing there; or
i) The supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
j) The supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
Operating Schedule Conditions: (None Applicable)
Noise
Noise from amplified and non-amplified music, singing and speech arising from regulated entertainment at the premises [between the hours of 23:00 and 07:00] shall not be audible inside habitable rooms of noise sensitive properties in the vicinity.
Informative Note:
Licensees are advised to carry out a simple “sound check” outside the nearest noise sensitive property by listening to the music etc. coming from regulated entertainment. If the music etc. is clearly audible then it is likely that this condition is being breached. Steps should then be taken to reduce the volume of the noise.
For the purpose of providing an objective standard to assess whether this condition is being complied with or not, noise shall be considered not to be audible if:
) the measurement of sound when music etc is on (expressed as LAeq, 1min) does not exceed the measurement of sound (expressed as LA90, 5min) when the music is off, and
) the measurement of sound in each 1/3rd octave band between 40Hz and 160 Hz when music is on (expressed as L10, 1min) does not exceed the measurement of sound in the same 1/3rd octave bands between 40Hz and 160Hz when the music is off (expressed as L90, 5min)
All measurements to be taken within the habitable room normally occupied at the time in question, using a Type 1 integrating-averaging sound level meter compliant with BS EN 60804, with either windows open for normal ventilation or closed, whichever situation causes greater noise disturbance.
All external doors and windows to the room/s where regulated entertainment is being provided shall remain closed during the course of the entertainment, other than for normal access and egress.
Prominent, clear notices shall be displayed at all exits requesting customers and staff to respect the needs of local residents and leave the premises and area quickly and quietly.
All external areas of the premises (beer gardens, patios etc) must not be used by customers between the hours of 23:00 and 08:00.
No speaker used to relay amplified music, singing and speech provided as part of the regulated entertainment shall be positioned outside the building structure of the premises, nor shall any speaker be positioned internally such that the sound is directed through external doors, windows or other openings in the structure.
Speakers used to relay amplified music, singing and speech provided as part of the regulated entertainment shall be played through a sound amplification system incorporating a sound limiting device that has been installed and ser to the express satisfaction of the Responsible Authority for Public Nuisance (Wakefield MDC's Environmental Protection Team). The sound-limiting device shall be retained and maintained throughout the life of the licence and no alteration to the approved setting shall be made without the express approval of the Responsible Authority.
Promotional leaflets (flyers) shall not be distributed to the public outside the premises (whether immediately outside or some distance away) except with the prior written approval of the Responsible Authority for Public Nuisance (Wakefield MDC’s Environmental Protection Team) under the terms of a litter control plan.
At the end of business every day/night, the pavement to the frontage (and sides) of the premises shall be cleared of litter and waste and cleansed of any urine, vomit or similar foulings.
ADVISORY NOTE:
You can help facilitate patrons leaving in a quiet manner through promoting a ‘calm down’ period at the end of the night. Finish any “lively” entertainment (disco, live music, etc) about 30 minutes before the bar closes and play softer background music. Continue to sell water, soft drinks and other non-alcoholic beverages and allow customers to leave naturally.
Fire Alarm and Emergency Lighting
The Fire Alarm and Emergency Lighting Systems are to be tested weekly and a written record of these tests is to be kept. Any faults identified and the relevant actions taken to rectify them are to be noted in the record.
Exit Routes
All exit routes must be kept clear and remain free from obstruction at all times.

Adult Entertainment
No adult entertainment shall take place on the premises.
First Aid Box
An appropriate first aid equipment box shall be provided at all times.
Local Pubwatch Scheme
The Designated Premises Supervisor shall continue to remain a member of the Local Pubwatch scheme for as long as such scheme remains in existence.
or
The Club shall continue to remain a member of the Local Pubwatch scheme for as long as such scheme remains in existence.
Proof of age cards
Any person on the premises who appears to be under 18 years of age attempting to purchase alcohol from the establishment shall be challenged to produce photographic evidence to ascertain their proof of age.
CCTV
CCTV shall be used on the premises. Cameras must be kept in full working order and the recordings shall be retained for a length of time in accordance with local police advice.
CRB checks
The licence holder shall ensure that all staff are positively CRB checked.
Text/ Radio pagers
Text and/ or radio pagers, where already used shall continue to be used for any additional hours the premises remains open to the public. The text/ radio pagers shall be maintained in working order at all times.
The pager link shall be activated, made available to and monitored by the designated premises supervisor or a responsible member of staff at all times that the premises are open to the public.
Any police instructions/ directions shall be complied with whenever given.
All instances of crime or disorder shall be reported via the text/ radio pager link by the designated premises supervisor or a responsible member of staff to an agreed police contact point.
The store shall continue to maintain the refusals log book which is currently in practice and to keep the log fully up to date with reference to recording those suspected of being under the age of 18.
Lighting
Adequate external lighting shall be provided at all times.
Toughened glass
All glasses that are used on the premises shall continue to be either made from toughened glass or plastic
All glasses that are used on the premises, when considered necessary during particular events (e.g. during sporting events etc), shall be made of either toughened glass or plastic.
Refusals Log
The store shall continue to maintain the refusals log book which is currently in practice and to keep the log fully up to date with reference to recording those suspected of being under the age of 18.
The store management shall regularly inspect the refusals log to ensure that it is being properly maintained.
Area management shall continue with the Company's requirement to periodically inspect the store and check that the refusal log of that store is being maintained and to report on this aspect in their store visit report.
Children
Children (as defined in the Licensing Act 2003) shall not be allowed on the premises unless accompanied by an adult at all times.
Children shall not be allowed to enter or remain on the premises after 22.00 hours.
None Standard Timing
Where the premises is to open for licensable activities to show the broadcast (up to 20 events) of televised sporting events of national or international interest outside normal licensed operating hours, at least 7 working days prior written notice shall be given to the Police and the Licensing Authority and is subject to consent by the Police.
Notification from the Licence holder to include in the intended opening times, the sporting event to be shown and what measures will be implemented to
promote the licensing objectives.
Emergency Lighting/ Exits
All emergency lighting and/or fire alarm system to be checked weekly and a record kept. Any faults identified and the relevant action taken to be noted.
All emergency exit routes to be kept clear and free from obstruction at all times
Notices to be displayed

Litter Bins/ Rubbish & Litter
Facilities for depositing rubbish outside the premises must be made available.
Litter bins shall be available for customer use outside the premises at all times the premises are trading.
Litter bins so provided at 4 above shall be emptied at regular intervals and at the end of trading every day.
All refuse (and waste bottle) receptacles shall be kept locked or otherwise secured so ass to prevent unauthorised access.

Outdoor Events
The premises licence holder must notify the West Yorkshire Fire and Rescue Service 28 days prior to each planned event at the premises covered by this licence.
The premises licence holder must notify the Council's Building Control Services prior to any event covered by this licence where use of temporary structures e.g. marquee, stage etc is employed.
The West Yorkshire Police and West Yorkshire Ambulance Services shall be informed in advance of all events covered by this licence.
A full risk assessment shall be undertaken in respect of all events covered by this licence.
Adequate first aid facilities shall be provided at all licensed events.
A lost children point shall be provided at all licensed events.
