Annex 1 - Mandatory Conditions
1. No supply of alcohol may be made under this Premises Licence:
a) at a time there is no designated premises supervisor in respect of the premises licence and,
b) at a time when the designated premises supervisor does not hold a personal licence or the personal licence is suspended and,
2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
4. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
5. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
6.-(1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
7. The responsible person shall ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
Annex 2 - Conditions consistent with the Operating Schedule
(None Applicable)
Annex 3 - Conditions attached after a hearing by the licensing authority
1. CCTV system to a specification requirement of West Yorkshire as per Home Office guidelines will be installed and utilised at the premises with sufficient storage capacity to store the previous 31 days’ footage. Staff will be trained in the use of the system to ensure rapid data retrieval and download when required by Police or Local Authority Enforcement Officers. CCTV to be active on a 24 hour basis and at least one member of staff, who is trained in downloading from the system, is on the premises when it is open for immediate CCTV footage retrieval.
2. New staff shall receive induction training at the commencement of employment. Regular staff training and re-training shall be undertaken and recorded. Staff training records shall be maintained for inspection by West Yorkshire Police and Local Authority Enforcement Officers. This training must include drug awareness training and underage sales training.
3. A proof of age scheme approved by West Yorkshire Police and West Yorkshire Trading Standards will be in operation and signs provided informing customers that sales will not be made to persons less than 18 years of age and identification may be required. A challenge 25 proof of age system will be adopted.
4. The DPS will ensure that an Incident Report Register is maintained on the premises to record incidents such as anti-social behaviour, and ejections from the premises. All incidents and crimes MUST be recorded.
5. The register will contain consecutively numbered pages in a bound format, the date, time and location of the incident, details of the nature of the incident, the names and SIA badge numbers of any door staff involved or to whom the incident was reported, the names and personal licence numbers (if any) of any other staff involved or to whom the incident was reported, the names and numbers of any police officers attending, names and addresses of any witnesses and confirmation of whether there is CCTV footage of the incident.
6. The Incident Report Register will be produced immediately for inspection on request by a police officer or council enforcement officer.
7. DPS or nominated deputy who shall be a Personal Licence Holder will be on site and contactable at all times and a register maintained on site of their details.
8. SIA/approved contactor status door supervisors shall be employed at the premises. Door staff to be used from opening until closing on Fridays and Saturdays, all Public Bank Holidays, Sunday before all Public Bank Holidays and New Year’s Eve.
9. Periodic employment of female Door Supervisors shall be evidenced in the Door Supervisors register.
10. Premises to be a member of the local Pub watch scheme and must send a representative to attend the meetings.
11. No children should be allowed on the premises after 6pm.
12. No customers apparently carrying open bottles or vessels upon entry shall be admitted to the premises at any time the premises are open to the public.
13. No customers will be allowed to take from the premises open bottles or vessels.
14. No adult entertainment shall take place on the premises.
15. Nite Net radio to be used when the premises are open.
16. All building, refurbishment, or other similar work taking place must comply with the Secure by Design concept. Close liaison must be sought from the Police Architectural Liaison Officer before any building work takes place. This work must be agreed and signed off by the Police Architectural Liaison Officer before any licensable activities take place.
17. The DPS will attend the local Drug awareness course and the DPS course run by Wakefield College as soon as is reasonably practicable. Evidence of these qualifications will be kept on the premises and will be made available to the Police or Local Authority officers on demand.
18. Capacity at the premises whilst licensable activities are taking place shall be 250.
19. A drug safe use by staff will be fitted in a secure location at the premises out of reach of access by the public and to which only premises management shall have access will be used on the premises.
20. No licensable activities shall take place until all relevant planning applications have been satisfied, building works have been completed to the satisfaction of Wakefield Council Building Control and a completion certificate has been issued by them to confirm compliance with all building regulations and the building is fit for purpose and safe for use by the general public.
21. All external doors and windows to the room/s where regulated entertainment is being provided shall remain closed during the course of the entertainment, other than for normal access and egress after the hours of 1900 hours.
22. No speaker used to relay amplified music, singing and speech provided as part of the regulated entertainment shall be positioned outside the building structure of the premises, nor shall any speaker be positioned internally such that the sound is directed through external doors, windows or other openings in the structure. For the avoidance of doubt, “outside the building structure” relates to the premises itself and not the Xscape complex.
23. The disposal of waste bottles in to external receptacles shall not take place between the hours of 2200 and 0900 hours.
24. At the end of business every night the frontage of the premises shall be cleared of litter and waste and cleansed of any urine, vomit or similar fouling.
