Annex 1 - Mandatory Conditions
1. No supply of alcohol may be made under this Premises Licence:
a) at a time there is no designated premises supervisor in respect of the premises licence and,
b) at a time when the designated premises supervisor does not hold a personal licence or the personal licence is suspended and,
2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
4. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
5. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
6. The admission of children to an exhibition of a film where the film classification body or this Council has determined the classification must be restricted in accordance with that classification. The film classification body is the British Board of Film Classification. In this condition children means persons under 18 years of age.
Films must be classified in the following way:
U - Universal. Suitable for audiences aged four years and over.
PG - Parental Guidance. Some scenes may be unsuitable for young children.
12A - Passed only for viewing by persons aged 12 years or older or persons younger than 12 when accompanied by an adult.
15 - Passed only for viewing by persons aged 15 years and over.
18 - Passed only for viewing by persons aged 18 years and over.
7. Immediately before each exhibition at the premises of a film passed by the British Board of Film Classification there shall be exhibited on screen for at least five seconds in such a manner as to be easily read by all persons in the auditorium a reproduction of the certificate of the Board or, as regards a trailer advertising a film, of the statement approved by the Board indicating the classification of the film.
8. Where a programme includes a film recommended by the licensing authority as falling into the 12A, 15 or 18 category no person appearing to be under the age of 12 and unaccompanied, or under 15 or 18 as appropriate, shall be admitted to any part of the programme; and the licence holder shall display in a conspicuous position a notice in the following terms:
PERSONS UNDER THE AGE OF [INSERT APPROPRIATE AGE] CANNOT BE ADMITTED TO ANY PART OF THE PROGRAMME.
Where films of different categories form part of the same programme, the notice shall refer to the oldest age restriction. This condition does not apply to members of staff under the relevant age while on-duty provided that the prior written consent of the person's parent or legal guardian has first been obtained.
9. Each individual carrying out a security activity must be licensed by the Security Industry Authority.
10. A record shall be kept of the names and registration number of such persons and this record shall include the circumstances including full details of all events that take place during their period of duty.
11.-(1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
12. The responsible person shall ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the
following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
Annex 2 - Conditions consistent with the Operating Schedule
(None Applicable)
Annex 3 - Conditions attached after a hearing by the licensing authority
1. CCTV system shall be installed to include
a) 1 camera with capability to record images of evidential quality to cover all Licensed Areas of the ground.
b) 2 cameras to be installed in the Private function Room in CATS bar and 1 camera on the main entrance to Cats Bar.
The installation shall follow Home Office guidelines and shall be in accordance with advice from West Yorkshire Police Licensing/ Architectural Liaison Officer. The CCTV shall have sufficient storage capacity to store the previous 31 days footage. Staff will be trained in the use of the system to ensure rapid data retrieval and download when required by Police or Local Authority Enforcement Officers. CCTV to be active on a 24hr basis and at least one member of staff, who is trained in downloading from the system, is on the premises when it is open.
2. New staff shall receive induction training at the commencement of employment. Regular staff training and re training shall be undertaken and recorded. Staff training records shall be maintained for inspection by West Yorkshire Police and Local Authority Enforcement Officers. This training must include drug awareness training and underage sales training.
3. A proof of age scheme approved by West Yorkshire Police and West Yorkshire Trading Standards will be in operation and signs provided informing customers that sales will not be made to persons less than 18 years of age and identification may be required. A “21”proof of age system will be adopted.
4. The DPS will ensure that an Incident Report Register is maintained on the premises to record incidents such as anti social behaviour, and ejections from the premises The register will contain consecutively numbered pages in a bound format, the date, time and location of the incident, details of the nature of the incident, the names and SIA badge numbers of any door staff involved or to whom the incident was reported, the names and personal licence numbers (if any) of any other staff involved or to whom the incident was reported, the names and numbers of any police officers attending, names and addresses of any witnesses and confirmation of whether there is CCTV footage of the incident. The Incident Report Register will be produced immediately for inspection on request by a police officer or council enforcement officer. All incidents reported that are within the knowledge of the staff at the venue must be recorded
5. DPS or a Personal Licence Holder will be on site and contactable at all times when alcohol is being sold and a register maintained on site of their contact details.
6. No customers carrying open bottles containing alcohol shall be admitted to the premises at any time the premises are open to the public.
7. No glass or glass bottles shall be taken outside.
8. Polycarbonate or plastic drinking vessels shall be used for events that take place when the outside bars are open and that cover the outside licensed areas.
9. At least one first aid trained member of staff will be on duty at all times the premises are open to the public.
10. The Licence Holder shall maintain a door staff daily record register, which is to be completed on a daily basis by the door staff when they commence and finish duty at all times as SIA Door Supervisors are employed at the premises.
11. The daily record register must be retained on the premises for a period for at least one year, taken from the date of the last entry and include the following:
a) Consecutively numbered pages
b) The registration number and full name of each registered person on duty.
c) The date and time that he/she commenced that period of duty with a signed acknowledgement by that person.
d) The time at which he/she finished duty with a signed acknowledgement by that person.
12. Daily record registers shall be produced for immediate inspection on request by an official of the SIA, Police or Licensing Authority.
13. License holders must have a written search policy for those entering the premises.
14. All members of staff must be acquainted with this policy.
15. Staff of both sexes shall be on duty to undertake any searches of the public.
16. Clear and visible notices should be displayed to those entering the premises detailing the establishments search policy. These signs should state that that police will be informed if anyone is found in possession of controlled substances or weapons.
17. Secure receptacles, to the standard as required by West Yorkshire Police, must be provided in a restricted part of the building for staff to deposit drugs and weapons.
18. Any seizure of controlled substances and weapons must be recorded in the incident report register and reported to the police at the earliest possible time.
19. Notices will be displayed at the entrances of the premises which state:
a) Random searches will be conducted as a condition of entry to the premises.
b) Incidents of crime and disorder will be reported to the Police
c) Entry to the premises will be refused to any person who appears drunk, acting in a threatening manner or is violent
20. All persons under the age of 16 years will be accompanied by an adult in any Private Function Room.
