Annex 1 - Mandatory Conditions
1. No supply of alcohol may be made under this Premises Licence:
a) at a time there is no designated premises supervisor in respect of the premises licence and,
b) at a time when the designated premises supervisor does not hold a personal licence or the personal licence is suspended and,
2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
4. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
5. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
6. Each individual carrying out a security activity must be licensed by the Security Industry Authority.
7. A record shall be kept of the names and registration number of such persons and this record shall include the circumstances including full details of all events that take place during their period of duty.
8.-(1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
9. The responsible person shall ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
Annex 2 - Conditions consistent with the Operating Schedule
Police Conditions
1. The Premises Licence only permits one event on one day per year to take place on the premises.
2. The date of the event will be notified to the Wakefield Police licensing department at least 4 months prior to the event taking place.
3. The Premises Licence Holder or a nominated deputy (in writing) must be on these licensed premises and available to the Responsible Authorities and the Licensing Authority at all times when Licensable activities are taking place.
4. Details of the Premises Licence Holder or his deputy who is on duty when licensable activities are undertaken shall be recorded, on these premises, at the time. These records shall be made available to the Licensing Authority or a Responsible Authority on demand. Such record shall be kept for a period of 12 months after the end of licensable activities. This information post event must be provided to The Licensing Authority or a Responsible Authority within 24 hours of the request.
5. The name and contact details of the Premises Licence Holder's deputy(s) will be provided to the Wakefield Police Licensing Department in writing no later than 7 days prior to the event each year.
6. At all times there shall be one personal licence holder on these premises for each bar which is open for the sale and supply of alcohol.
7. A schedule will be provided of details of the personal licence holder who is on duty and their areas of responsibilities when licensable activities are undertaken on these premises at that time. This will be made available to the Wakefield Police Licensing Department and or other responsible authorities during the period of the event on demand. Such record shall be kept for a period of 12 months after the end of licensable activities.
8. The names and contact details of the personal licence holders will be provided to the Wakefield Police Licensing Department no later than 7 days prior to the event each year.
9. The draft of the Event Management Plan (EMP) will be produced 3 months prior to the event each year and will be submitted to all responsible authorities who will determine whether that draft EMP is acceptable or unacceptable within one calendar month of receipt. Where notification is not received the draft EMP shall be deemed by the Premise Licence Holder to be agreed. The event shall not take place until the EMP has been agreed by all responsible authorities. Once agreed no change shall be made to the draft EMP without the agreement of all responsible authorities.
10. Each year, an EMP and updates must be provided to the responsible authorities. The EMP will be a working document providing details of how the event is to be conducted and how safety issues, identified in the event risk assessment, are to be addressed. The EMP will include an event risk assessment and provide specific details on the following areas:

Crowd Management (including steward and security numbers and their roles)

11. Each year the event must take place in accordance with the final agreed EMP produced for the Festival following approval by all responsible authorities.
THE PREVENTION OF CRIME AND DISORDER
12. The Premises Licence Holder or nominated representative (in writing) will meet with the on duty operational Police commander at least once a day during the event each year.
Security and Stewards
13. A Security Control will be provided on site.
Numbers of Personnel
14. A written schedule shall be provided, 3 months prior to the start of the event, of the number and position of SIA Security personnel to be employed on site by hour of day, during the period the premises is licensed for licensable activities. Such schedule must be agreed by the event operational commander of West Yorkshire Police at least 7 days prior to the first day of the event.
15. A written schedule shall be provided, 3 months prior to the start of the event, of the number and position of personnel to be employed as stewards on site by hour of day during the period the premises is licensed for licensable activities such schedule must be agreed by the event operational commander of West Yorkshire Police at least 7 days prior to the first day of the festival.
16. The Premises Licence Holder or DPS or a person nominated by them in writing for the purpose, shall maintain a register of door supervisors which shall be kept on the premises showing the names and addresses of the door supervisors, their badge numbers. The register shall be made available on demand for inspection by Police, Licensing Authority
or an authorised officer of the Security Industries Authority. Additionally the Premises Licence Holder will have in place at least one SIA door staff member who will wear and operate ‘body worn video’ camera or a hand held digital recording camera. They will be located as a default at each licensed bar area during licensable hours where they will have the capacity to deploy to any incidents at other locations where required, but must return to their default position afterwards. Camera operators will be trained in use of the equipment and record incidents where they feel appropriate. The only exception for use of these cameras will be in the area of the ‘guest/artists’ bars which have restricted and controlled access. Equipment must be maintained in good working order , be correctly time and date stamped, recordings must be kept in date order, numbered sequentially and kept for a period of 31 days and handed to Police immediately on demand. The Premises Licence Holder must ensure at all times a DPS or appointed member of staff is capable and competent at downloading
CCTV footage in a recordable format disc to the Police on the direction from the operational commander during the duration of the event or from any other member of West Yorkshire Police post event or the Local Authority on demand. The Recording equipment and discs shall be kept in a secure environment under the control of the DPS or other responsible named
individual. An operational daily log report must be maintained endorsed by signature, indicating the system has been checked and is compliant, in the event of any failings actions taken are to be recorded. In the event of technical failure of the CCTV equipment the Premises Licence holder/DPS MUST report the failure to the Police.
17. No person under the age of 18 years will be employed as stewarding personnel.
18. No person under the age of 21 years will be employed as SIA badged staff.
19. No security staff or stewards are to consume or be under the influence of alcohol or drugs whilst working. They shall be fit to carry out the duties required of them.
Security Uniforms and Security Logs
20. All security and stewarding personnel will be readily identifiable by means of a tabard bearing a job title and a conspicuous unique personal identification number. This identification number will be displayed prominently on the front and rear and will be at least 30mm high and the width of the written number shall be at least 10 mm.
21. The details of the uniform(s) to be worn by the security and stewarding personnel will be provided 3 months prior to the first day of the event and approval of West Yorkshire Police be given within 7 days of receiving the information.
22. No person shall perform the role of stewarding personnel without wearing a tabard.
23. No person shall perform the role of security personnel (apart from a plain clothed team) without wearing a tabard. All plain clothes security personnel shall carry an identity badge issued by the Premises Licence Holder confirming that they are security personnel which shall be produced to a member of the Licensing Authority or Police on demand.
24. West Yorkshire Police will be informed of onsite security and steward briefings and may attend if they wish.
25. An incident log must be kept at the premises, and made immediately available on request to an ‘authorised person’ (as defined by Section 13 of the Licensing Act 2003) or Police, which must record the following:
(a) all crimes reported to the venue
(b) all ejections of patrons
(c) any complaints received
(d) any incidents of disorder
(e) seizures of drugs or offensive weapons
(f) any faults in the CCTV system or searching equipment or scanning
equipment
(h) any visit by a relevant authority or emergency service
26. Secure and safe systems are to be in place for the storage of items seized. These systems are to included secure methods of storing any drugs or weapons seized or found and procedures for handing the items over to the responsible authority where required. In addition records of seizure are to be kept in the incident book and made available to the Licensing Authority on demand or to the police on authority of the operational commander during the duration of the event or to any authorised person of West Yorkshire Police post event.
27. A Traffic Management Plan (TMP) will be drawn up for the event each year and will be provided to relevant agencies no later than 3 months prior to the event. . The TMP will cover all aspects of vehicle and pedestrian access to and egress from the site during the ' load in and load out as well as for the event itself. The TMP will include arrangements for vehicle routes, emergency service routes, public transport, shuttle buses, taxis, pedestrian issues, a dispersal policy, car parking and a traffic signage plan.
PUBLIC SAFETY
28. The premises Licence Holder will provide a facility where one person from each of the Responsible Authorities will be offered a place to maintain a presence on the Licensed Premises.
29. The maximum permitted numbers in each enclosed structure where regulated entertainment activities are to be provided will be submitted and agreed by the Responsible Authorities prior to the commencement of each Festival.
30. The premises licence holder must submit, within their EMP, arrangements to the satisfaction of the responsible authorities on how such maximum occupancy capacities will be managed.
31. Paper lanterns will not be sold on site and will be listed within the terms of entry and conditioned as items that may not be brought to the venue.
THE PROTECTION OF CHILDREN FROM HARM
Under 16s
32. Any unaccompanied person under the age of 16 years found on the Licensed Premises will be accompanied to the Welfare Tent. This task will be undertaken by at least 2 members of staff.
33. No unaccompanied person under the age of 16 years shall be permitted on the Licensed Premises.
Criminal Records Bureau (CRB) Check
34. Any personnel whose role involves the looking after of children or vulnerable adults shall have a current enhanced DBS check.
35. No person shall be involved in this role unless the enhanced DBS shows ‘None Recorded’ against the following categories:
Police Record of Convictions, Cautions, Reprimands and Warning
Information from the list held under Section 142 of the Education Act 2002
ISA Children’s Barred List Information
ISA Vulnerable Adults Barred List Information
Other relevant information disclosed at the Chief Police Officer(s)
discretion
36. The premises licence holder will be responsible for being in possession of all enhanced DBS check reports relating to personnel who are responsible for dealing with children & vulnerable adults.
37. The goal of the Lost Children Policy is to reunite each lost child with its parents or guardians. However if there is any evidence or suspicion of abuse or neglect of children, then this must be reported to the appropriate authority.
Age Verification
38. The premises shall operate a Challenge 25 Policy. Such policy shall be written down and kept at the premises. The policy shall be produced on demand of the Licensing Authority or Police. Prominent, clear and legible signage (in not less than 32 font bold) shall also be displayed at all entrances to the premises as well as at, at least once every 5 metres behind any bar advertising the scheme operated.
39. In conjunction with point above, proof of the attainment of 18 years of age will be required through production of a PASS card, full or provisional photo card driving licence, or by a photo passport prior to any alcohol sale taking place or entry to age restricted areas.
40. Prominent, clear and legible signage (in not less than 32 font bold) shall be displayed stating that: It is an offence to purchase or attempt to purchase alcohol if you are under the age of 18 - Section 149 Licensing Act 2003.
41. A register of refusals will be kept by each bar with the names of people who have been unable to provide required Identification to prove their age. These records will be collected on a daily basis by the Designated Premises Supervisor and made available to the Licensing Authority or Police on request.
42. The Designated Premises Supervisor will brief bar security staff in the arena and the campsites (if applicable) bars that they should take reasonable steps to monitor the final destination of the drinks and where it would appear that supply is being made to a person under the age of 18 years take steps to prevent the consumption by that person.
43. No bar servers will be under 18.
44. The Designated Premises Supervisor, the bar manager and other bar supervisors will monitor the performance of the serving staff to ensure adherence to the licensing laws.
45. Any persons who are found arriving at or on the Licensed Premises with alcohol will have the alcohol confiscated by security.
46. A selection of soft drinks will be available to buy, along with an ample supply of free drinking water at clearly signed locations throughout the Licensed Premises.
47. Each bar will be run by a bar manager and this person under the direction of the Designated Premises Supervisor will be fully in control of the sale of alcohol from that bar.
48. All staff shall be trained prior to undertaking any sale of alcohol on the premises. The training shall included:
Drugs Awareness;
Conflict resolution;
Selling to under age person;
Selling to drunks;
Such training will be recorded and records shall be kept at the premises which will be produced to an ‘authorised person’ (as defined by Section 13 of the Licensing Act 2003) or Police on demand.
49. All drinks provided by the onsite bars shall be in plastic/polycarbonate vessels or plastic bottles .
50. Admission will be by ticket only.
51. There will be a 9,999 capacity in the venue.
52. There will only be two “beer tents/marquees” serving alcohol within the area defined as the “Premises Licence”.
53. There will be no overnight camping within the area defined as the “Premises Licence”.
Environmental Health Conditions
Before the event:
54. At least 4 weeks prior to the event a noise action plan must be submitted in writing or electronically (ep@wakefield.gov.uk <mailto:ep@wakefield.gov.uk>) for approval by the Wakefield MDC’s Environmental Health Services detailing;
The Nature of the event to be held.
The name and contact number of the responsible person/noise consultant to be on site during the event.
The actions that will be taken before and during the event to ensure compliance with the noise conditions outlined below.
A copy of the information to be provided to residents who may be affected by noise from the event and details of how that information is to be disseminated. The aforementioned information shall include details of the event, start/finish time and name and telephone number of the responsible person/noise consultant that can be contacted on the night.
During the event:
55. The L(Aeq 15 min) measured not less than 1 metre from the façade of the noise sensitive premises (being premises where the occupants are likely to suffer nuisance from excessive noise) shall not exceed 65dB(A) over a 15 minute period.
56. The Sound Pressure Level, at 1 metre from the facade of any noise sensitive premises, should not exceed 71dB in either of the 63Hz or 125Hz octave frequencies.
After the event:
57. No more than two weeks after the event, the applicant shall send a post event report to either in writing or electronically to Wakefield MDCs Environmental Health Services. The report shall include:
58. Names and address of any complaints of noise and the action taken.
59. Monitoring results collected on the day/night.
60. Details of any breaches of the noise levels specified and action taken.
61. Any recommendations for future events.
62. On the day of the event the site will be staffed by an SIA licensed security firm, freelance contractors, volunteer stewards and attended by members of the emergency services.
63. All volunteer stewards and security personnel will be included prior to the event and familiarised with all the health and safety information and emergency procedures, this
Information will also be sent electronically to all subcontractors such as stall-holders.
64. The site itself will be fenced off from the rest of Pontefract Park with 8' high hoarding panels. Access to the site is through two points, both staffed with security personnel and
stewards. This will enable us to control who can move in and out of the site and what they can bring with them.
65. All members of the security staff, emergency service and the site supervisors will be in radio contact to ensure that all emergency and non-emergency procedures are carried out
swiftly and in an organised manner.
66. In order to stop illegal substances being brought onto the site, bag searches will take place before attendees pass through the ticket barrier, any persons discovered to be
carrying illicit contraband substances or items will be passed onto the Police to be dealt with accordingly. During the bag searches, any alcohol being brought onto the site will be
confiscated; this will allow bar staff and security staff to control instances of under-age or excessive drinking.
67. In order to minimise any disorder, stewards will be stationed in pre-arranged spots along the ingress and egress routes to the site to guide attendees in the direction least likely to
cause disruption. The Police will be furnished with a plan of these routes, and the stations of the stewards, and can be directed to the source of any disturbance reported.
68. We anticipate that many of the attendees may make their way into Pontefract town centre or Xscape after the event so we will inform the managers of the various venues to expect a higher than normal turn out on the day of the event. We will also inform the Police of these movements in order for them to best direct their efforts.
69. During the event, members of the public will be able to contact the noise consultant in order for them to come and measure the sound levels at individual properties. If the readings are falling below the guideline limits, no action will be taken; if they are above the guideline limits, the consultant will be in direct communication with the sound control desk and instruct them to reduce the volume.
