Annex 1 - Mandatory Conditions
No supply of alcohol may be made under this Premises Licence:
a) at a time there is no designated premises supervisor in respect of the premises licence and,
b) at a time when the designated premises supervisor does not hold a personal licence or the personal licence is suspended and,
Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
The admission of children to an exhibition of a film where the film classification body or this Council has determined the classification must be restricted in accordance with that classification. The film classification body is the British Board of Film Classification. In this condition children means persons under 18 years of age.
Films must be classified in the following way:
U - Universal. Suitable for audiences aged four years and over.
PG - Parental Guidance. Some scenes may be unsuitable for young children.
12A - Passed only for viewing by persons aged 12 years or older or persons younger than 12 when accompanied by an adult.
15 - Passed only for viewing by persons aged 15 years and over.
18 - Passed only for viewing by persons aged 18 years and over.
Immediately before each exhibition at the premises of a film passed by the British Board of Film Classification there shall be exhibited on screen for at least five seconds in such a manner as to be easily read by all persons in the auditorium a reproduction of the certificate of the Board or, as regards a trailer advertising a film, of the statement approved by the Board indicating the classification of the film.
Where a programme includes a film recommended by the licensing authority as falling into the 12A, 15 or 18 category no person appearing to be under the age of 12 and unaccompanied, or under 15 or 18 as appropriate, shall be admitted to any part of the programme; and the licence holder shall display in a conspicuous position a notice in the following terms:
PERSONS UNDER THE AGE OF [INSERT APPROPRIATE AGE] CANNOT BE ADMITTED TO ANY PART OF THE PROGRAMME.
Where films of different categories form part of the same programme, the notice shall refer to the oldest age restriction.
This condition does not apply to members of staff under the relevant age while on-duty provided that the prior written consent of the person's parent or legal guardian has first been obtained.
Each individual carrying out a security activity must be licensed by the Security Industry Authority.
A record shall be kept of the names and registration number of such persons and this record shall include the circumstances including full details of all events that take place during their period of duty.
Annex 2 - Conditions consistent with the Operating Schedule
1. No adult entertainment shall take place on the premises.
2. Children (as defined in the Licensing Act 2003) shall not be allowed on the premises unless accompanied by an adult at all times.
Annex 3 - Conditions attached after a hearing by the licensing authority
1. Not to allow customers of the premises to take open drink containers outside the premises at any time.
2. To erect and maintain to the satisfaction of the Environmental Health Officer an acoustic fence adjacent to the premises entrance. If planning permission for the fence is required then the fence is to be erected within 28 days of planning permission being granted. If no planning permission is required then the fence is to be erected before the 3rd February 2008.
3. Not to use the bottle waste between the hours of 8:00pm and 10:00am.
4. To liaise with taxi firms to ensure that taxis and private hire vehicles attend on the Wakefield Road side of the premises. Taxi drivers should be requested not to sound their horns.
5. Prominent clear notices should be displayed at all exits and in the car park and smoking area requesting customers and staff to respect the needs of the local residents and use areas and leave the premises quietly.
6. Speakers used to relay amplified music, singing and speech provided as part of the regulated entertainment shall be played through a sound amplification system incorporating a sound limiting device that has been installed and set up by the Licence Holder so as to prevent any breach of condition 7 of Annex 3 of the Licence.
7. Noise from amplified and non-amplified music, singing and speech arising from regulated entertainment at the premises between the hours of 23:00 and 7:00 shall not be audible inside habitable rooms of noise sensitive premises in the vicinity. The applicant should carry out a simple sound check outside the nearest noise sensitive properties by listening to music etc coming from regulated entertainment. If the music etc is clearly audible then it is likely that this condition is being briefed and steps should be taken to reduce the volume of the noise. The applicant should keep a written log of such sound checks which should be made available for inspection by the Environmental Health Officer when requested.
8. All external doors and windows to the rooms where regulated entertainment is being provided shall remain closed during the course of the entertainment except for normal access and egress. The fire escape doors should only be used in cases of emergency and the stage door use should be restricted for use of artists only and not general use of the public to access and egress the building except in an emergency.
9. Any fire door to the premises shall be sound proofed by fitting an acoustic seal and panel. These are to be maintained to the satisfaction of the Environmental Health Officer. The door should also be bolted to prevent it being opened except in the event of an emergency.
10. The applicant shall employ at least two suitably qualified door supervisors between 7:00pm and 1:00am on Friday and Saturday for the purpose of preventing noise and anti-social behaviour in the vicinity of the premises.
11. On a daily basis, the pavement, frontage and car park areas shall be cleared of litter and waste and also cleared of any urine, vomit or similar fouling.
