Annex 1 - Mandatory Conditions
1. The admission of children to an exhibition of a film where the film classification body or this Council has determined the classification must be restricted in accordance with that classification. The film classification body is the British Board of Film Classification. In this condition children means persons under 18 years of age.
Films must be classified in the following way:
U - Universal. Suitable for audiences aged four years and over.
PG - Parental Guidance. Some scenes may be unsuitable for young children.
12A - Passed only for viewing by persons aged 12 years or older or persons younger than 12 when accompanied by an adult.
15 - Passed only for viewing by persons aged 15 years and over.
18 - Passed only for viewing by persons aged 18 years and over.
2. Immediately before each exhibition at the premises of a film passed by the British Board of Film Classification there shall be exhibited on screen for at least five seconds in such a manner as to be easily read by all persons in the auditorium a reproduction of the certificate of the Board or, as regards a trailer advertising a film, of the statement approved by the Board indicating the classification of the film.
3. Where a programme includes a film recommended by the licensing authority as falling into the 12A, 15 or 18 category no person appearing to be under the age of 12 and unaccompanied, or under 15 or 18 as appropriate, shall be admitted to any part of the programme; and the licence holder shall display in a conspicuous position a notice in the following terms:
PERSONS UNDER THE AGE OF [INSERT APPROPRIATE AGE] CANNOT BE ADMITTED TO ANY PART OF THE PROGRAMME.
Where films of different categories form part of the same programme, the notice shall refer to the oldest age restriction. This condition does not apply to members of staff under the relevant age while on-duty provided that the prior written consent of the person's parent or legal guardian has first been obtained.
Annex 2 - Conditions consistent with the Operating Schedule
1. The premises licence holder must notify the Council's Building Control Services prior to any event covered by this licence where use of temporary structures e.g. marquee, stage etc is employed.
2. A full risk assessment shall be undertaken in respect of all events covered by this licence.
3. Adequate first aid facilities shall be provided at all licensed events.
4. CCTV shall be used on the premises. Cameras must be kept in full working order and the recordings shall be retained for a length of time in accordance with local police advice.
5. The Senior Events Officer will be accountable for ensuring that each event has a designated lead individual who will have considered the following:
(a) The location of generators, plant, speakers and amplification equipment, taking into account all aspects of health and safety and noise in relation to sensative premises.
(b) The location of food stalls in relation to sensitive premises.
(c) Participants in events, e.g. fairground rides have insurance and safety certificates.
(d) Participants working with children, e.g. Father Christmas will have valid CRB clearance.
(e) Cleansing services will have been informed of the event to ensure that the area may be cleaned afterwords, attention may be given to additional aspects of waste during each event.
(f) Inform emergency services, police, fire and A & E services of each event where appropriate.
(g) Complete a risk assessment for each event.
(h) Ensure a first aid and police presence at each event where appropriate.
(i) Ensure a security presence at each event where appropriate.
(j) Liaise with appropriate responsible authorities where concerns are raised/ or clarification is required in relation to public nuisance concerns.
(k) Where a firework display is to be included as part of an event, ensure that the firework regulations 2004 are adhered to.
(l) To provide a clear point of contact for the duration of each event where complaints/ concerns can be raised.
(m) Inform by letter, prior to the event, all sensitive premises who will possibly suffer some form of disruption due to the event or actions that have to be taken in order for the event to take place, e.g. road closures.
