Annex 1 - Mandatory Conditions
1. No supply of alcohol may be made under this Premises Licence:
a) at a time there is no designated premises supervisor in respect of the premises licence and,
b) at a time when the designated premises supervisor does not hold a personal licence or the personal licence is suspended and,
2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
4. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
5. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
6.-(1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
7. The responsible person shall ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
Annex 2 - Conditions consistent with the Operating Schedule
Embedded Restrictions:
S.164 - Licensing Act 1964
Alcohol shall not be sold in an open container or be consumed in the licensed premises.
S. 59 60 63 67A 68 70 74 76 - Licensing Act 1964
Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours means:
a) On weekdays, other than Christmas Day, Good Friday or New Year’s Eve, 10am to 11pm.
b) On Sundays, other than Christmas Day or New Year’s Eve, 12 noon to 10.30pm.
c) On Good Friday, 12 noon to 10.30pm.
d) On Christmas Day, 12 noon to 3pm and 7pm to 10.30pm.
e) On New Year’s Eve, except on a Sunday, 11am to 11pm.
f) On New Year’s Eve on a Sunday, 12 noon to 10.30 pm.
g) On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31 December).
The above restrictions do not prohibit:
a) During the first twenty minutes after the above hours the consumption of the alcohol on the premises;
b) During the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
c) During the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;
d) Consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
e) The ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
f) The sale of alcohol to a trader or club for the purposes of the trade or club;
g) The sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
h) The taking of alcohol from the premises by a person residing there; or
i) The supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
j) The supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
S.94 95 - Licensing Act 1964
Alcohol may be sold or supplied:
1) On weekdays, other than Christmas Day, Good Friday or New Year’s Eve from 11 am to 12 p.m.
2) On Sundays, other than Christmas Day or New Year’s Eve, and on Good Friday: 12 noon to 11.30 p.m.
3) On Christmas Day: 12 noon to 11.30 p.m.
4) On New Year’s Eve, except on a Sunday, 11 am to midnight.
5) On New Year’s Eve on a Sunday, 12 noon to 11.30 p.m.
6) On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31st December).
The above restrictions do not prohibit:
a) during the first twenty minutes after the above hours the consumption of the alcohol on the premises;
b) during the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
c) during the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals.
d) consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the premises.
Suitable non-alcoholic beverages, including drinking water, shall be equally available for consumption with or otherwise as an ancillary to meals served in the licensed premises.
The premises must be bona fide used for the purpose of habitually providing the customary main meal at midday or in the evening, or both, for the accommodation of persons frequenting the premises.
The premises must be bona fide used for the purpose of:
(a) habitually providing the customary main meal at midday or in the evening, or both, for the accommodation of persons frequenting the premises; and
(b) habitually providing for reward board and lodging including breakfast and one other at least of the customary main meals.
S.168 168A 171 201 SCH 12A - Licensing Act 1964
No person under fourteen shall be in the bar of the licensed premises during the permitted hours unless one of the following applies:
(1) He is the child of the holder of the premises licence.
(2) He resides in the premises, but is not employed there.
(3) He is in the bar solely for the purpose of passing to or from some part of the premises which is not a bar and to or from which there is no other convenient means of access or egress.
(4) The bar is in premises constructed, fitted and intended to be used bona fide for any purpose to which the holding of the licence is ancillary.
(5) (a) He is in an area shown on the plan attached to the licence.
(b) Meals and non-alcoholic beverages are available for sale for consumption in that area.
(c) He is in the company of a person aged 18 or over.
(d) He is there:
(i) prior to 9 p.m. or
(ii) between 9 p.m. and 9.30 p.m. where he or the said person is consuming a meal purchased before 9 p.m.
In this condition “bar” includes any place exclusively or mainly used for the consumption of intoxicating liquor. But an area is not a bar when it is usual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals.
Operating Schedule Conditions
CONDITIONS - VICE PRESIDENTS LOUNGE
1. That intoxicating liqour may be sold on the ocasion of a sporting event taking place at the premises of Castleford Tigers Rugby League Football Club, Wheldon Road, Castleford.
2. The sale and consumption of such intoxicating liqour shall be restricted to bona fide persons attending the club premises on those occasions.
3. Intoxicating liqour may also be sold and consumed at the occasion of a bona fide private function which has previously been arranged between the organisers of the function and the licencee.
4. NB a bona fide private function is defined as a dinner, dance, concert, meeting, wedding celebration or any other similar private function.
5. Intoxicating liqour shall only be consumed in the areas of the club premises which are outlined on a plan deposited with the clerk to the licensing justices
6. There will be no OFF sales for consumption outside the licenced area.
RESTAURANT LICENCE
7. Intoxicating liqour shall only be consumed in the areas of the club premises which are outlined on the plan deposited with the clerk to the licensing justices.
8. There will be no OFF sales for consumption outside the licenced area.
CHILDRENS CERTIFICATE
9. This certificate shall be operational between the following hours and on the following days, namely:
SUNDAY TO SATURDAY FROM 11AM TO 9PM
10. Meals and beverages other than intoxicating liqour shall be available for consumption in the area(s) to which this certificate relates at all times when the certificate is operational.
11. In areas covered by children's certificates the accompanying adults(s) must be able to see the children with them at all times.
12. Plastic or paper containers should be available for a children's drink.
13. All electrical sockets in public areas shall be adequately protected.
14. A menu shall be available at all times either with a children's section or indicating that half portions are available.
15. A notice shall be displayed on the amusments with prizes machine indicating that they are not to be played by persons under 18 years of age.
16. A no smoking area, as indicated on the plan deposited with the clerk to the licensing justices shall be provided.
Licensing Act 2003 Condtions
1. CCTV
1.1 The premises shall install and maintain a CCTV system as per the minimum requirements of the West Yorkshire Police Licensing Department and current Home Office Guidelines. The CCTV system shall have sufficient storage capacity to store a minimum of 31 days footage & record images at 7-12 Frames Per Second (FPS).
(Advisory Note:-The CCTV System must be registered with Information Commissioners Officer (ICO) to ensure compliance with the Data Protection Act 1998 (DPA).)
1.2 Cameras shall be installed and located at the following locations bottle banks, Stands, Terrace, rugby pitch, Tiger Bar, Supporters Bar, Platinum Suite, Restaurant Suite and Marquee Bar to enable evidential quality. All entry and exit points will be covered enabling frontal identification of every person entering in any light condition.
1.3 All elements of the CCTV System must be maintained in good working order, recordings shall be kept in date order & retained for a period of at least 31 days, or as otherwise in recommended by the police.
1.4 Staff shall be trained in the operation of the CCTV system to ensure rapid data retrieval & downloads of footage can be provided to the Police & the Local Authority Officer on demand.
1.5 CCTV shall be active on a 24 hour basis and at least one member of staff who is trained in downloading from the system must be on the premises during trading hours.
1.6 In the event of a failure of the CCTV system for any reason, a record of the failure will be recorded in the premises’ incident book and immediate steps will be made to rectify the problem.
2. DPS
2.1 The Designated Premises Supervisor must be at the premises and contactable at all times during Match hours and a telephone contact made available at all times. An up to date register be maintained on the premises of these contact details.
2.2 The Designated Premises Supervisor must have completed a drug awareness course.
2.3 All persons responsible for the management of the premises, including the Designated Premises Supervisor and Supervisors, shall attend and complete the BIIAB Award in Conflict Management Course. This training shall be cascaded to all staff at the venue so that all staff at the premises receive conflict management training.
3. Training
3.1 All staff shall receive induction training at the commencement of their employment at the premises, including drug awareness, underage sales & serving alcohol to drunks training.
3.2 Regular training to all staff shall be undertaken on a 6 monthly basis and recorded.
3.3 All staff training shall be recorded and training records maintained and available immediately for inspection by West Yorkshire Police and Local Authority Enforcement Officers upon request.
4. Proof of Age Scheme
4. 1 The premises shall adopt a proof of age scheme approved by West Yorkshire Police and West Yorkshire Trading Standards providing for proof of age for sales to persons who appear to be below the age of 25. Signs shall be provided within the premises informing customers that sales shall not be made to persons under the age of 18 and that identification may be required.
4.2 The only acceptable form of identification are a UK driving licence, Passport & any PASS accredited photographic card.
4.3 All persons under the age of 16 years will be accompanied by an adult in the Tiger Bar, Marquee Bar, Restaurant Suite, Platinum Suite, Supporters Bar.
5. Incident / Refusals Register
5.1 An Incident Report Register shall be maintained and kept on the premises to record all incidents involving:-Crimes reported to the venue, anti-social behaviour, injury, ejections of patrons from the premises, any incidents of disorder, all seizures of drugs or offensive weapons; Any faults in the CCTV system, any refusal of the sale of alcohol & any visit by a relevant authority or emergency.
5.2 The register shall also include the details of any police officer who attend any incident, names and addresses of any witnesses and confirmation as to whether there is CCTV footage of the incident. This register shall be made available for inspection by West Yorkshire Police or Local Authority Enforcement Officers immediately upon request.
5.3 The register will contain consecutively numbered pages in a bound format and include the date, time and location of the incident, details of the nature of the incident, the names and SIA badge numbers of any door staff involved or to whom the incident was reported to and names of any other staff involved or to whom the incident was reported.
5.4 The DPS or nominated manager will inspect the incident register on a weekly basis to ensure that the document is being maintained correctly. The DPS or nominated manager will sign and date an entry accordingly to verify the above.
6. Door Supervisors
6.1 SIA and Approved Contractor Status door supervisors shall be employed at the premises and shall be on duty at all times. They shall be on duty a minimum of 1 hour before the start of any match or event and a minimum of 1 hour after any match or event.
6.2 There shall be a minimum number of two door supervisors for capacities of up to 100 people, Thereafter there shall be at least one door supervisor per additional 100 people or part thereof. This will apply for all events and functions including boxing and wrestling within the marquee. This will also apply to the Tiger Bar & Restaurant Suite when they are operating their extending their opening hours on Christmas Eve & New Years Eve. This ruling applies to the Licensed bar areas only.
6.3 At least one female door supervisor shall be on duty at the premises periodically (at least once per month).
7. Door Supervisors Register
7.1 The Licence Holder shall maintain a Door Supervisor Record Register, which is to be completed by door staff when they commence and finish duty at all times as SIA Door Supervisors are employed at the premises during match days and events.
7.2 The Door Supervisor Record Register must be retained on the premises for a period for at least one year, taken from the date of the last entry and include the following:
a) Consecutively numbered pages.
b) The registration number and full name of each registered person on duty.
c) The date and time that he/she commenced that period of duty with a signed acknowledgement by that person.
d) The time at which he/she finished duty with a signed acknowledgement by that person.
7.3 Daily record registers shall be produced for immediate inspection on request by an official of the SIA, Police or Licensing Authority.
7.4 License holders must have a written search policy for those entering the premises.
7.5 All members of staff must be acquainted with this policy.
7.6 Staff of both sexes shall be on duty to undertake any searches of the public.
7.7 Clear and visible notices should be displayed to those entering the premises detailing the establishments search policy. These signs should state that that police will be informed if anyone is found in possession of controlled substances or weapons.
7.8 Secure receptacles, to the standard as required by West Yorkshire Police, must be provided in a restricted part of the building for staff to deposit drugs and weapons.
7.9 Any seizure of controlled substances and weapons must be recorded in the incident report register and reported to the police at the earliest possible time.
7.10 Notices will be displayed at the entrances of the premises which state:
Random searches will be conducted as a condition of entry to the premises. Incidents of crime and disorder will be reported to the Police
Entry to the premises will be refused to any person who appears drunk, acting in a threatening manner or is violent
8. Open Bottles and Vessels
8.1 Polycarbonate or plastic drinking vessels shall be used for match days and events that take place. This will include all Bottle Banks, Tiger Bar, Supporters Bar and Marquee. (The only exception to this are the Platinum Suite and Restaurant Suite were alcohol is served with a meal, entry is regulated to members only and entry and exit is regulated by a Door Supervisor)
8.2 No customers carrying bottles or open bottles containing alcohol shall be admitted into the ground at any time the premises are open to the public.
8.3 No glass or glass bottles shall be taken outside the Platinum or Restaurant Suites at any time.
8. 4 The disposal of waste bottles into external receptacles shall not take place between the hours of 21:00 and 09:00.
9. First Aid
9.1 At least one suitably trained first aider who is responsible for first aid shall be on duty when the public are present and there shall be a notice clearly identifying the first aider. For the avoidance of any doubt, ‘suitably trained first aider’ means that the individual has obtained a qualification in first aid and that the provider of this training and qualification is approved by a nationally recognised awarding body.
9.2 If more than one suitably trained first aider is present at the premises, their respective duties should be clearly defined;
9.3 The Licensee shall ensure that there is an adequate and appropriate supply of first aid equipment and material at the premises in accordance with the relevant Health & Safety Legislation.
10. Pub Watch
10.1 The premises shall be a member of the local Pubwatch scheme and at least one representative of the premises, with Management or supervisory responsibility, shall attend each meeting.
11. Substance Misuse
11.1 The Premises Licence Holder or nominated person shall ensure that a drugs safe is available on the premises, which cannot be accessed by the public. Only the management of the premises shall have access, to deposit suspected seized, found or handed in controlled drugs.
11.2 There will be a clear policy for handling and packaging of such seized or found controlled drugs. Controlled drugs seized or found must be formally deposited at the nearest police station within 24hrs or as soon as practically possible and in any case no later than 72 hours.
11.3 All items of controlled drugs seized, found or handed to the premises shall be recorded in the incident register.
12. Suites with food provision
12. 1 The Platinum Suite & Restaurant Suite will operate only as a restaurant with sales of alcohol being ancillary to a table meal. The only exceptions to this rule will be:-
Customers attending pre-booked bona-fide functions by way of ticket or invitation. Such functions must be booked at least 48 hours before the day of the event and recorded in a diary kept for that purpose. This diary will be made available immediately for inspection by the Police and licensing authorities upon demand
12.2 There will be a minimum number of 40 covers maintained on the ground floor area & a minimum number of 80 covers maintained on the 1st floor area within the restaurant at any time.
13. Under 18 Events
13.1 The Premises Licence Holder, DPS or nominated person with Supervisory or Management Responsibility, shall provide the Police Licensing Department with written notice of any under 18’s event to be held at the premises. The Premises Licence Holder, DPS or nominated person with Supervisory or Management Responsibility, shall provide the Police Licensing Department with all information relating to the event, including a management plan in respect of the event and shall work in conjunction with the Police, complying with any requests, to ensure that children are protected and prevented from harm and that crime and disorder associated with the event or venue is minimised.
