Annex 1 - Mandatory Conditions
No supply of alcohol may be made under this Premises Licence:
a) at a time there is no designated premises supervisor in respect of the premises licence and,
b) at a time when the designated premises supervisor does not hold a personal licence or the personal licence is suspended and,
Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Each individual carrying out a security activity must be licensed by the Security Industry Authority.
A record shall be kept of the names and registration number of such persons and this record shall include the circumstances including full details of all events that take place during their period of duty.
Annex 2 - Conditions consistent with the Operating Schedule
Embedded Restrictions: (None Applicable)
Operating Schedule Conditions:
1. Fire alarm and emergency lighting systems are to be tested weekly and a record maintained.
2. No one under the age of 18 will be allowed to enter or remain on the premises after 22:00 save on Christmas Eve and New Year's Eve.
3. Anyone who appears to be under the age of 21 and who is attempting to buy alcohol must be required to produce proof of age before such a sale is made.
4. No adult entertainment shall take place on the premises.
5. The Designated Premises Supervisor shall continue to remain a member of the Local Pubwatch scheme for as long as such scheme remains in existence.
6. Adequate internal and external lighting shall be provided at all times.
7. The store shall continue to maintain the refusals log book which is currently in practice and to keep the log fully up to date with reference to recording those suspected of being under the age of 18.
8. The store management shall regularly inspect the refusals log to ensure that is being properly maintained.
9. Children (as defined in the Licensing Act 2003) shall not be allowed on the premises unless accompanied by an adult at all times.
Annex 3 - Conditions attached after a hearing by the licensing authority
1. Live music shall cease at 23.00 hours on all days.
2. Karaoke shall cease at 23.00 hours on all days.
3. Noise from amplified and non-amplified music arising from regulated entertainment at the premises shall not be audible beyond the boundaries of the premises and the applicant shall carry out sound checks at the boundaries of the premises to ensure that this condition is not breached. A log should be kept of the checks made.
Informative Note:
Licensees are advised to carry out a simple “sound check” outside the nearest noise sensitive property by listening to the music etc. coming from regulated entertainment. If the music etc. is clearly audible then it is likely that this condition is being breached. Steps should then be taken to reduce the volume of the noise.
For the purpose of providing an objective standard to assess whether this condition is being complied with or not, noise shall be considered not to be audible if:
) the measurement of sound when music etc is on (expressed as LAeq, 1min) does not exceed the measurement of sound (expressed as LA90, 5min) when the music is off, and
) the measurement of sound in each 1/3rd octave band between 40Hz and 160 Hz when music is on (expressed as L10, 1min) does not exceed the measurement of sound in the same 1/3rd octave bands between 40Hz and 160Hz when the music is off (expressed as L90, 5min)
All measurements to be taken within the habitable room normally occupied at the time in question, using a Type 1 integrating-averaging sound level meter compliant with BS EN 60804, with either windows open for normal ventilation or closed, whichever situation causes greater noise disturbance.
4. All external doors and windows shall remain closed during the course of all entertainment other than for normal access and egress.
5. The licence holder shall erect signs at each exit advising customers to leave the premises quietly so as not to affect residents.
6. The licence holder shall write to all taxi firms in the area advising them that drivers should not sound horns at any time whilst waiting for a customer.
7. The disposal of waste bottles into external receptacles shall not take place between the hours of 21.00 hours and 07.00 hours and the bottle bank should be securely closed except when in use by the applicant.
8. The applicant will not allow the beer garden and any other external part of the premises to be used by customers after 21.00 hours other than for normal access and egress.
9. No glass containers are to be used by customers in the beer garden or the exterior part of the premises.
