Annex 1 - Mandatory Conditions
No supply of alcohol may be made under this Premises Licence:
a) at a time there is no designated premises supervisor in respect of the premises licence and,
b) at a time when the designated premises supervisor does not hold a personal licence or the personal licence is suspended and,
Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
The admission of children to an exhibition of a film where the film classification body or this Council has determined the classification must be restricted in accordance with that classification. The film classification body is the British Board of Film Classification. In this condition children means persons under 18 years of age.
Films must be classified in the following way:
U - Universal. Suitable for audiences aged four years and over.
PG - Parental Guidance. Some scenes may be unsuitable for young children.
12A - Passed only for viewing by persons aged 12 years or older or persons younger than 12 when accompanied by an adult.
15 - Passed only for viewing by persons aged 15 years and over.
18 - Passed only for viewing by persons aged 18 years and over.
Immediately before each exhibition at the premises of a film passed by the British Board of Film Classification there shall be exhibited on screen for at least five seconds in such a manner as to be easily read by all persons in the auditorium a reproduction of the certificate of the Board or, as regards a trailer advertising a film, of the statement approved by the Board indicating the classification of the film.
Where a programme includes a film recommended by the licensing authority as falling into the 12A, 15 or 18 category no person appearing to be under the age of 12 and unaccompanied, or under 15 or 18 as appropriate, shall be admitted to any part of the programme; and the licence holder shall display in a conspicuous position a notice in the following terms:
PERSONS UNDER THE AGE OF [INSERT APPROPRIATE AGE] CANNOT BE ADMITTED TO ANY PART OF THE PROGRAMME.
Where films of different categories form part of the same programme, the notice shall refer to the oldest age restriction.
This condition does not apply to members of staff under the relevant age while on-duty provided that the prior written consent of the person's parent or legal guardian has first been obtained.
Each individual carrying out a security activity must be licensed by the Security Industry Authority.
A record shall be kept of the names and registration number of such persons and this record shall include the circumstances including full details of all events that take place during their period of duty.
Annex 2 - Conditions consistent with the Operating Schedule
1. CCTV system to a specification required by West Yorkshire Police as per Home Office guidelines will be installed and utilised at the premises with sufficient storage capacity and requirement to store the previous 31 days footage. Staff will be trained in the use of the system to ensure rapid data retrieval and down load when required by Police or Local Authority Officers. CCTV to be on a 24 hour basis and at least one member of staff to who is trained in downloading from the system is on the premises when it is open.
2. SIA approved/contracted status, Door Supervisors or Contractors shall be employed at the premises. The premises shall be responsible for the management of the Door Staff in the premises. Door staff to be used at the premises when relevant events dictate
3. Door Supervisors register shall be maintained and shall be the property of the premises and available for inspection by West Yorkshire Police and Local Authority Enforcement Officers.
4. Periodic employment of female Door Supervisors when relevant events are taking place shall be evidenced in the Door Supervisor register.
5. The Designated Premises Supervisor shall continue to remain a member of the Local Pubwatch scheme for as long as such scheme remains in existence.
6. Carbonated incident logbooks shall be maintained and retained for aperiod of one year taken from the date of the last entry,and include the following
a) consecutively numbered pages.b)the date and time of any incident.c)the nature of the incident.d)the full names of staff involved including the badge number of any doorstaff and to whom the incident was reported,including the names and numbers of any Police officerswho attended the scene of the incident and details of any witnesses.The incident report log must be made available for inspection by West Yorkshire Police and Local Authority Enforcement Officers.
7. New staff shall receive induction training at the commencement of employment. Regular staff training and re-training shall be undertaken and recorded staff training records shall be maintained for inspection by West Yorkshire Police and Local Authority Enforcement Officers. This training must include drug awareness training and underage sales training.
8. A proof of age scheme approved by WYP and WYTSS will be in operation and signs provided informing customers that sales will not be made to less than 18,s and identification may be required. A 25 proof of age system will be adopted.
9. DPS or nominated deputy will be onsite and contactable at all times and a register maintained on site of details of DPS.
10. No customers will be allowed to take from the premises open bottles or vessels.
11. Where required by the police a text, pager or radio will be used to keep in contact with other premises in Wakefield.
12. Such text, pager or radio shall be kept in good working order and shall be monitored by responsible member of staff.
13. Relevant incidents of crime and disorder shall be reported to the Police via the text, pager or radio if applicable.
14. No person who is drunk or disorderly will be allowed access to or be allowed to remain on the premises.
15. No person who is the subject of a court banning order or who is restricted access through a Pubwatch scheme will be allowed in the premises provided the details of such person have been provided to the premises by the police.
16. Any customer who behaves inappropriately will be barred from the premises and their details passed to any relevant Pubwatch scheme.
17. Tables will be cleared of all empty bottles and glasses on a regular basis.
18. Any glasses into which drink is dispensed will be made from toughened shatterproof glass.
19. There shall be a suitable number of adequately trained staff to prevent overcrowding in parts of the premises, keep exit routes clear and to ensure the safe evacuation of people from the premises. Such staff will have been issued with specific duties in the event of an emergency.
20. All staff shall have received training on the safe evacuation of the premises in the event of an emergency and such training shall be repeated at least annually. A record of the training provided shall be kept at the premises for at least 12 months and will be made available to the Fire Service or Council on request.
21. At least one first-aider trained to deal with problems associated with alcohol and drugs will be on duty and if there are more than one on duty their roles will be clearly defined.
22. All electrical installations will be inspected by a competent person before the expiry of the current electrical certificate and the certificate issued will be the current standard form certificate issued by that competent person's professional body.
23. If any work is undertaken to the electrical installation it will be inspected, tested and certified by a competent person as soon as possible.
24. An adequate supply of free drinking water shall be provided for all customers.
25. The holder of the premises licence shall maintain suitable and sufficient sound attenuation throughout the whole building.
26. The holder of the premises licence shall adopt a bespoke dispersal policy for the premises and shall provide any of the responsible authorities with a copy of it if requested.
27. Noise or vibration from within the premises or from any plant machinery or equipment shall not emanate from the premises so as to cause a nuisance to any residential dwelling.
28. A person under the age of 18 will only visit the venue with a responsible adult usually for the purpose of dining unless there is an event especially organised for the youth market.
