Annex 1 - Mandatory Conditions
No supply of alcohol may be made under this Premises Licence:
a) at a time there is no designated premises supervisor in respect of the premises licence and,
b) at a time when the designated premises supervisor does not hold a personal licence or the personal licence is suspended and,
Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Each individual carrying out a security activity must be licensed by the Security Industry Authority.
A record shall be kept of the names and registration number of such persons and this record shall include the circumstances including full details of all events that take place during their period of duty.
Annex 2 - Conditions consistent with the Operating Schedule
Embedded Restrictions:
OFF LICENCES AND OFF SALES DEPARTMENTS OF ON-LICENSED PREMISES
S.60 63 86 - Licensing Act 1964
Alcohol shall not be sold or supplied except during permitted hours.
The above restrictions do not prohibit:
a) during the first twenty minutes after the above hours, the taking of the alcohol from the premises, unless the alcohol is supplied or taken in an open vessel;
b) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
c) the sale of alcohol to a trader or club for the purposes of the trade or club;
d) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
OFF LICENCE
S.164 - Licensing Act 1964
Alcohol shall not be sold in an open container or be consumed in the licensed premises.
ON-LICENCES
S. 59 60 63 67A 68 70 74 76 - Licensing Act 1964
Alcohol shall not be sold or supplied except during permitted hours.
The above restrictions do not prohibit:
a) During the first twenty minutes after the above hours the consumption of the alcohol on the premises;
b) During the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
c) During the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;
d) Consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
e) The ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
f) The sale of alcohol to a trader or club for the purposes of the trade or club;
g) The sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
h) The taking of alcohol from the premises by a person residing there; or
i) The supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
j) The supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
Conditions attached to Justices' ON and OFF Licence
1 Intoxicating liquor may only be sold or supplied to the following persons:-
a persons who are members of the Snooker Club being persons duly admitted to the said Club who have been duly admitted to membership in accordance with the rules of the club and who have been a member for at least 48 hours prior to admission and who have attained the age of 18 years.
b a guest of such a member who has attained the age of 18 years introduced by him in accordance with the rues of the club.
c persons employed at the said premises who have attained the age of 18 years.
2 No persons under the age of 14 years shall be eligible for membership at the said club.
2a Juvenile members of the club, that it to say persons who are aged 14 - 17 years inclusive shall be identified by a differently coloured membership card which shall record the date of birth of the said member.
3 Subject to rule 4 below, no persons under 18 years of age shall be admitted to the club.
4 Juveniles over 14 years of age may be admitted as a member of the guest of a member, but will not be allowed within the licensed bar area nor permitted to play the gaming machines. The member is responsible (at all times) for the good behaviour of the child.
5 Subject to rule 6 below, guests of members (including juveniles) shall "sign in" their visit in a book kept for that purpose and be available for inspection by a police constable in uniform on demand.
6 On the actual day or days on which any match shall be played at the club premises all visiting members of any opposing club r team and the referee or referees of any such matches shall be regarded as visitors of the club including the right to be supplied with orsold intoxicating liquor for consumption on the premises but all visitors (including juveniles) shall "sign in" their visit in a book kept for the purpose of inspection by a police constable in uniform on demand.
7 One member may only introduce three guests at any one time.
7a No person who is admitted as a guest of a member shall be permitted to purchase intoxicating liquor at any time.
8 No intoxicating liquor shall be sold or supplied to any persons fro consumption OFF the premises except a member in person who has attained the age of 18 years.
9 No application under the authority of this licence shall be made for the grant of an occasional licence or an occasional permission.
10 A copy of the rules of the club as approved by the Licensing Justices on the grant of this licence shall be deposited with the Clerk to the Licensing Justices and the holder of the licence shall forthwith notify the said Clerk of any alteration in the said rules.
11 A complete list of members of the club shall be maintained and kept available on the premises to be inspected by a police constable in uniform if required on demand.
12 There shall be no gaming on the said premises subject to section 34 Permit and the discretion of the Gaming Committee to grant registration under Part 111 of the Gaming Act 1968.
13 To comply with the recommendations of the Fire Officer.
Operating Schedule Conditions:
1. Noise from amplified and non-amplified music, singing and speech arising from regulated entertainment at the premises [between the hours of 23:00 and 07:00] shall not be audible inside habitable rooms of noise sensitive properties in the vicinity.
Informative Note:
Licensees are advised to carry out a simple “sound check” outside the nearest noise sensitive property by listening to the music etc. coming from regulated entertainment. If the music etc. is clearly audible then it is likely that this condition is being breached. Steps should then be taken to reduce the volume of the noise.
For the purpose of providing an objective standard to assess whether this condition is being complied with or not, noise shall be considered not to be audible if:
) the measurement of sound when music etc is on (expressed as LAeq, 1min) does not exceed the measurement of sound (expressed as LA90, 5min) when the music is off, and
) the measurement of sound in each 1/3rd octave band between 40Hz and 160 Hz when music is on (expressed as L10, 1min) does not exceed the measurement of sound in the same 1/3rd octave bands between 40Hz and 160Hz when the music is off (expressed as L90, 5min)
2. All measurements to be taken within the habitable room normally occupied at the time in question, using a Type 1 integrating-averaging sound level meter compliant with BS EN 60804, with either windows open for normal ventilation or closed, whichever situation causes greater noise disturbance.
3. All external doors and windows to the room/s where regulated entertainment is being provided shall remain closed during the course of the entertainment, other than for normal access and egress.
4. All external areas of the premises (beer gardens, patios etc) must not be used by customers between the hours of 22:00 and 11:00.
5. No live bands are permitted under the 'live music' element of the premises licence, only solo artists, duo's and karaoke singers.
ADVISORY NOTE:
You can help facilitate patrons leaving in a quiet manner through promoting a ‘calm down’ period at the end of the night. Finish any “lively” entertainment (disco, live music, etc) about 30 minutes before the bar closes and play softer background music. Continue to sell water, soft drinks and other non-alcoholic beverages and allow customers to leave naturally
6. The Fire Alarm and Emergency Lighting Systems are to be tested weekly and a written record of these tests is to be kept. Any faults identified and the relevant actions taken to rectify them are to be noted in the record.
7. All exit routes must be kept clear and remain free from obstruction at all times.
8. Any person on the premises who appears to be under 18 years of age attempting to purchase alcohol from the establishment shall be challenged to produce photographic evidence to ascertain their proof of age.
9. All children (as defined in the Licensing Act 2003) shall not be allowed on the premises unless accompanied by an adult at all times.
10. All children shall not be allowed to enter or remain on the premises after 19.30 indefinitely.
11. No adult entertainment shall take place on the premises.
