Annex 1 - Mandatory Conditions
1. (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
2. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
3. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
4.-(1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
5. The responsible person shall ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the
following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
Annex 2 - Conditions consistent with the Club operating Schedule
Embedded restrictions
CLUB PREMISES
Permitted Hours
Alcohol shall not be sold or supplied except during permitted hours.
The above restrictions do not prohibit:
a) during the first twenty minutes after the above hours, the consumption of the alcohol on the premises;
b) during the first twenty minutes after the above hours, the taking of alcohol from the premises, unless the alcohol is supplied or taken in an open vessel;
c) during the first thirty minutes after the above hours, the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied as ancillary to the meals;
d) the supply to, or consumption by, any person of alcohol in any premises where they are residing.
Operating Schedule Conditions
1. Any alcohol supplied for consumption off the premises must be in a sealed container.
2. Any supply of alcohol for consumption off the premises must be made to a member of the club in person.
3. CCTV
3.1 A CCTV system to a specification required by West Yorkshire Police and in accordance with current Home Office Guidelines be installed and utilised at the premises with a sufficient storage capacity to store a minimum of 31 days footage;
3.2 Equipment shall be operated and maintained in good and clear working order and retained for a period of at least 31 days, or as otherwise recommended by the police;
3.3 Staff shall be trained in the use of the system to ensure rapid data retrieval and download when required by Police or Local Authority Enforcement Officers;
3.4 CCTV shall be active when the premises are trading and at least one member of staff who is trained in downloading from the system shall be on the premises during trading hours.
4. Training
4.1 New staff shall receive induction training at the commencement of their employment at the premises, including drug awareness and underage sales
Training.
4.2 Regular staff training shall be undertaken periodically and recorded. For the avoidance of doubt, periodically shall be every three months.
4.3 All staff training shall be recorded and training records maintained and available immediately for inspection by West Yorkshire Police and Local Authority Enforcement Officers upon request;
4.4. The premises shall adopt a proof of age scheme approved by West Yorkshire Police and West Yorkshire Trading Standards providing for proof of age for sales to persons who appear to be below the age of 25. Signs shall be provided within the premises informing customers that sales shall not be made to persons under the age of 18 and that identification may be required.
5. An Incident Report Register shall be maintained and kept on the premises to record all incidents involving anti-social behaviour, injury and ejections from the premises. The register will contain consecutively numbered pages in a bound format and include the date, time and location of the incident and details of the nature of the incident, The register shall also include the details of any police officer who attend any incident, names and addresses of any witnesses and confirmation as to whether there is CCTV footage of the incident. This register shall be made available for inspection by West Yorkshire Police or Local Authority Enforcement Officers immediately upon request.
6. A committee member with responsibility for the sales of alcohol must be contactable at all times during trading hours and a register is maintained on the premises of their details.
7. Open Bottles and Vessels
7.1 No open bottles or vessels shall be permitted entry to the premises at any time during trading hours;
7.2 No customers shall be permitted to take open bottles or vessels from the premises at any time during trading hours.
8. Noise from amplified and non-amplified music, signing and speech arising from regulated entertainment at the premises between the hours of 21:00 and 07:00 shall not be audible inside habitable rooms of noise sensitive properties in the vicinity
9. No speaker used to relay amplified music, singing and speech provided as part of the regulated entertainment will be positioned outside the building structure of the premises, nor shall any speaker be positioned internally so that sound is intentionally directed through external doors, windows or other openings in the structure.
10. The disposal of waste bottles into external receptacles shall not take place between the hours of 21:00 and 09:00.
11. No children as defined in the Licensing Act will be allowed on the premises after 21.30hrs. All children must be accompanied by a responsible adult.
12. No adult entertainment shall take place on the premises.
13. Signs shall be placed at all exits advising customers to leave the premises quietly.
14. The Fire Alarm and Emergency Lighting Systems are to be tested weekly and a written record of these tests is to be kept. Any faults identified and the relevant action taken to rectify them are to be noted in the record.
15. All exit routes must be kept clear and remain free from obstruction at all times.
16. When permission is sought for the sale or supply of alcohol during non-standard hours for any Bank Holiday period, an event of national interest or a televised sporting event of national interest, then the following will apply:
1. The Applicant must give West Yorkshire Police and the Local Authority at least 10 clear working days written notice of any Bank Holiday period or any other event of national interest.
2. The non standard hours shall only apply to one hour before and one hour after a televised sporting event of national interest and a maximum of two additional hours in any one day to any other event of national interest.
3. The Applicant must have made no more than 12 such applications relating to either an event of national interest or televised sporting event of national interest in any one calendar year.
4. If after the 5th working day commencing the day after the request is received, West Yorkshire Police do not respond, then consent will be deemed granted.
5. In relation to any request for non-standard hours, West Yorkshire police retain the right to suggest any reasonable variation in promoting the prevention of crime and disorder objective.
17. Children will only be allowed access to the main lounge and the garden area.
18. Prominent, clear notices shall be displayed at all exits requesting members to respect the needs of local residents and leave the premises and area quietly.
