Annex 1 - Mandatory Conditions
1. No supply of alcohol may be made under this Premises Licence:
a) at a time there is no designated premises supervisor in respect of the premises licence and,
b) at a time when the designated premises supervisor does not hold a personal licence or the personal licence is suspended and,
2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
4. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
5. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
6. Each individual carrying out a security activity must be licensed by the Security Industry Authority.
7. A record shall be kept of the names and registration number of such persons and this record shall include the circumstances including full details of all events that take place during their period of duty.
8.-(1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
9. The responsible person shall ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
Annex 2 - Conditions consistent with the Operating Schedule
1. CCTV system to a specification required by West Yorkshire Police as per Home Office guidelines will be installed and utilized at the premises with sufficient storage capacity and requirement to store the previous 31 days footage. Staff will be trained in the use of the system to ensure rapid data retrieval and download when required by Police or Local Authority Enforcement Officers. CCTV to be active on a 24hr basis and at least one member of staff, who is trained in downloading from the system, is on the premises when it is open.
2. New staff shall receive induction training at the commencement of employment. Regular staff training and re training shall be undertaken and recorded. Staff training records shall be maintained for inspection by West Yorkshire Police and Local Authority Enforcement Officers. This training must include drug awareness training and underage sales training.
3. A proof of age scheme approved by West Yorkshire Police and West Yorkshire Trading Standards will be in operation and signs provided informing customers that sales will not be made to persons less than 18 years of age and identification may be required. A “21”proof of age system will be adopted.
4. The Designated Premises Supervisor or nominated deputy will be onsite and contactable at all times and a register maintained on site of their details
5. The Designated Premises Supervisor will ensure that an Incident Report Register is maintained on the premises to record incidents such as anti social behaviour, and ejections from the premises.
6. The register will contain consecutively numbered pages in a bound format, the date, time and location of the incident, details of the nature of the incident, the names and SIA badge numbers of any door staff involved or to whom the incident was reported, the names and personal licence numbers (if any) of any other staff involved or to whom the incident was reported, the names and numbers of any police officers attending, names and addresses of any witnesses and confirmation of whether there is CCTV footage of the incident.
7. The Incident Report Register will be produced immediately for inspection on request by a police officer or council enforcement officer.
8. SIA & ACS registered door supervisors shall be employed at the premises from 2100hrs until the premises close on Fridays, Saturdays and all Sundays before Bank Holiday Mondays. In addition, one SIA & ACS door supervisor shall be employed at the premises each Tuesday from 2100hrs, only when the premise trades past midnight or is determined by a risk assessment, to the end of buisness. If the number of customers reaches 100, a second SIA & ACS door supervisor shall be employed at the premises and the ratio shall be further increased to SIA & ACS door supervisor for each further 100 customers or part thereof. Door supervisors shall be employed from 2100hrs until the premises close on Xmas Eve & New Years Eve. Door Staff shall be employed at the ratio of 2 per first 100 guests, and 1 per further 100 or part thereof.
9. Periodic employment of female Door Supervisors shall be evidenced in the Door Supervisors register.
10. Premises to be a member of the local Pubwatch scheme and must send a representative to attend the meetings.
11. No customers apparently carrying open bottles upon entry shall be admitted to the premises at any time the premises are open to the public.
12. No customers will be allowed to take from the premises open bottles or vessels.
13. No adult entertainment shall take place on the premises.
14. CCTV radio to be used when the premises are open.
15. A drug safe for use by staff will be fitted in a secure location at the premises out of reach of access by the public and to which only premises management shall have access will be used on the premises.
16. The Designated Premises Supervisor (DPS), or nominated duputy, shall keep a record (log book) of staff fire drills and testing of equipment. The record (log book) must be initialled each week by the DPS, or other suitable person, and the record shall be open to inspection at any reasonable time by authorised Officers of the Council and by the Fire Service.
17. The emergency lighting shall be provided from a source other than that of the general lighting and shall be tested before the commencement of each performance. The result of the testing, faults and remedial action shall be kept in a record (log book) signed on completion by the DPS or other suitable person. The record (log book) shall be kept available for inspection by authorised Officers of the Council and the Fire Service.
18. All Emergency Exits to be kept clear and free from obstructions at all times.
19. The level of noise emanating from within the curtilage of the premises to which this licence applies shall be controlled such that no disturbance is caused to occupiers of premises in the vicinity.
20. Where required by the Council conspicuous notices shall be positioned at all exits requesting patrons to make the minimum amount of noise on leaving.
21. Except where exemption is granted in writing by the Council, no sound amplification system(s) shall be operated in association with the premises as a result of the granting of this licence unless it is installed through a sound limiting device connected to the electrical circuitry. The limiting device shall be installed by a competent person and must always be operated when such amplified sound is generated. The Council shall approve the level to which the device must be set according to the agreed circumstances under which the entertainments are provided (e.g. doors and windows open or closed etc.). Prior to introducing any changes which will increase the impact of the entertainments on surrounding occupiers the Council shall be contacted so that the level set on the limiting device can be reviewed.
22. A sign will be located at the exit(s) requesting that customers leaving the premises do so quietly and with consideration to neighbours.
23. All external doors and windows to the room/s where regulated entertainment is being provided shall remain closed during the course of the entertainment, other than for normal access and egress.
24. No speaker used to relay amplified music, singing and speech provided as part of the regulated entertainment shall be positioned outside the building structure of the premises, nor shall any speaker be positioned internally such that sound is directed through external doors, windows or other openings of the structure.
